are legislative action - which all leads to a gray area - where does <br />administrative end and legislative begin? <br /> <br />Audience Comment - What, if any, City business currently accomplished by <br />resolution will have to be accomplished by ordinance if we go charter? <br /> <br />Commissioner Sieber replied that that question would be.~discussed later. <br /> <br />Audience Comment - How can we stop Council from doing something that will <br />cost the citizens money? Can we put a financial cap on Council? <br /> <br />Commissioner Sieber - That question will be answered during discussion of <br />the budget chapter. <br /> <br />Chairman Heitman pointed out that an item by which people have control is <br />initiative and referendum, attempt to get appropriate business accomplished <br />by ordinance which the people can repeal or accept. <br /> <br />Audience Comment - Council cannot repeal an existing ordinance; can they <br />create an ordinance without the approval of the people? <br /> <br />Chairman Heitman - Yes, but the people could subject it to referendum. <br /> <br />Audience Comment - Does the charter address the publishingof upcoming <br />Council agendas, concerned about action being taken during Citizen Input? <br /> <br />Commission Sieber - Ordinances cannot be acted upon the same night they are <br />proposed. <br /> <br />Commissioner Gamec - According to Ramsey's ordinance and State Statutes, a <br />public hearinq must be conducted on all issues requiring a variance; the <br />public hearing and Council action can take place at the same meeting. <br /> <br />Audience Comment - What you are saying is that there is a time period between <br />when something is introduced and when it is acted on; and if this is not <br />expressed in the charter, it is covered by State Statutes. <br /> <br />Commissioner Gamec - Noted that this procedure applies to requests that <br />require a variance because they differ from what ordinance states. <br /> <br />Chairman Heitman - A charter does not overried ordinances that currently <br />exist, but that does not mean that an ordinance cannot be amended. <br /> <br />Audience Comment - Want to be sure no important action is taken during <br />Citizen Input of Council agenda. <br /> <br />Commissioner Gamec - Citizen Input was included in the Council agenda at <br />the request of the residents. Council could possibly act on something <br />brought up during Citizen Input but the policy generally, has been to place <br />the item on another agenda. <br /> <br />Commissioner Lichter pointed out that if the City goes charter, Council <br />would have to adopt ordinances fouhd to be necessary to bring the operations <br />of the City into compliance with the charter. <br /> <br />Commissioner Gamec - With regards to publishing the proposed agenda, Ramsey <br />currently does so in the legal newspaper. <br /> <br />CC/September 28, 1983 <br /> Pu6lic Hearing <br /> Page 3 of 11 <br /> <br /> <br />
