Chairman Heitman - Publishing agenda has not been addressed in the charter. <br /> <br />Commissioner Lichter referred to Chapter 8 and noted that ~he procedure for <br />special assessments, if adopted, will vary greatly from the current procedure. <br />A special assessments project will require a petition of 35% in number of <br />the benefitted property owners presenting that petition to Council and <br />requesting a feasibility study. Council would act accordingly. City is <br />required to publish the resolution in the City newsletter and notify all <br />people in the affected area. The people would ~hen have an opportunity to <br />present a counter-petition. If the number of people in the counter-petition <br />is greater than those Signing the original petition -- Council would have to <br />refuse the original petition. <br /> <br />Commissioner Sieber - Chapter 8 is one of the chapters in which there are a <br />great many gray, legal areas. This chapter expresses the Commission's intent, <br />but whether or not it can be written in this exact manner is in question. <br />The Council does have legal counsel. <br /> <br />Audience Comment - Is is true that Council can order improvements to an <br />area by a 4/5 vote? Would like to see a more difficult procedure for Council. <br /> <br />Chairman Heitman - There is a period of 60 days which shall lapse between <br />the public hearing and Council action. A petition filed with Council during <br />that 60 days could curtail the proposed improvement. <br /> <br />Commissioner Sieber noted that maybe Council should have the power to order <br />in necessary improvements like sealcoating (sealcoating is considered an <br />improvement and is accomplished by special assessments). Council will also <br />taking the feelings of the citizens into consideration when making their <br />decision. <br /> <br />Audience Comment - Would like to see a financial ceiling put on Council° <br /> <br />Audience Comment - Costs continually go up - it would be hard to fix a dollar <br />amount. What did the Commission model Chapter 8 after? <br /> <br />Chairman Heitman - Mounds View's charter, in part. <br /> <br />Audience Comment - If the citizens petition for an improvement and the dollar <br />amount exceeds the fixed limit, you are denying the citizens what they <br />petitioned for. <br /> <br />Commissioner Sieber suggested that the ceiling on financial spending could <br />be a certain percentage of the assessed valuation of the City. <br /> <br />Audience Comment - In early 1983, a ½ mil brought in $3,000,000 in revenue in <br />Anoka County and today a ½mil will only bring in $500,000.
