Audience Comment - Have we gotten away from the concept of people petitioning <br />for improvements, but a larger class will end up paying for the improvement? <br /> <br />Commissioner Lichter - There is a celing set by State law in affect. If the <br />people don't agree with that amount of money being spent, they can petition <br />Council to put the issue to'a referendum. <br /> <br />Audience Comment - How will this affect MSA roads for which we receive State <br />funding. If 25% of the registered voters don'~ want the project, can they <br />halt it? <br /> <br />Commissioner Sieber - Noted that wording in section 8.04.02 'less than 100%' <br />would exclude MSA portion -- if enough people care to they can get a petition <br />against the project. <br /> <br />Audience Co~nent - In some cases, street improvement petitions are received <br />late in the construction season. If you propose a 60 day waiting period <br />after the public hearing, it could push construction out to the following <br />year and at an increased cost. Recommend 30 day waiting period. <br /> <br />Commissioner Sieber - I believe that is the way it is proposed in the charter. <br />If everybody wants it done, why should we be concerned about doing it? <br />Why should we have any rules at all? Let's make them up as we go. <br /> <br />Chairman Heitman - On the other hand, that only allows 30 days for the <br />citizens to react to an ordinance. <br /> <br />Audience Comment - Has referendum been used in any of the surrounding charter <br />cities? <br /> <br />Audience Comment - In ~iounds View, since 1978, they have only had to go to <br />the polls once with a special election. <br /> <br />Audience Comment - 60 days is too strict. <br /> <br />Commissioner Sieber - It is a 60 day period after an improvement has been <br />petitioned for and adopted. The intent is to give benefitted residents an <br />opportunity to react. <br /> <br />Chairman Heitman - Council is able to act immediately on improvements now. <br /> <br />Audience Conment - There is a waiting period before Council can approve plans <br />an specs and go for bids. <br /> <br />Commissionr Sieber - All time frames should happen from the time of the public <br />hearing because that is when all citizens have an opportunity to find out <br />about the project. <br /> <br />Audience Comment - Since copies of this proposed charter just became available <br />to the citizens tonight, are you planning on holding more workshops for the <br />public benefit? <br /> <br />Chairman Heitman - Copies distributed tonight are only a rough draft and we <br />will ~ntertain the idea of future public hearings. <br /> <br />Audience Comment - Would like to see workshops to address some of the more <br />complicated chapters. <br /> <br />CC/September 28, 1983 <br /> Public Hearing <br /> Page § of 11 <br /> <br /> <br />
