Commissioner Sieber - We recognize and admit that there are holes in this <br />charter. We would not even dream of submitting to a vote before it was <br />submitted to legal counsel first. <br /> <br />Audience Comment - If legal counsel is being paid to attend this meeting <br />we have a right to his input. <br /> <br />Mr. Dorn- I have pointed out portions 'that are concerning and need legal <br />research to the Commission. The Commission has come up withaproduct they <br />Want -- now they are going for public and legal input. This document can <br />be changed substantially if they find theyare legally indefensible. I do <br />not want to address to the public any points that have been brought up tonight, <br />I have not researched it enough to be of any benefit right now, <br /> <br />Audience Comment - What portions concern Mr. Dorn? <br /> <br />Mr. Dorn- I have discussed Chapter 8 with the Commission to some degree. I <br />have to really go through the entire charter before I can thoroughly evaluate <br />whether or not my comments to them made any sense. <br /> <br />Chairman Heitman - There are 12 chapters and they are interrelated. We will <br />obtain a legal opinion but to request it on a rough'draft is not appropriate. <br /> <br />Commissioner Sieber - This is not the charter that you will be voting on. <br />Do you Want a progressive City deciding to get tax base in at all costs, do <br />you want a dictorial form of government, government by the people, or <br />inbetween? <br /> <br />Audience Comment - How much do special elections cost the City? <br /> <br />Commissioner Gamec - The election regarding the charter will run about $3200 <br />and special issue elections will run about $6900. <br /> <br />Audience Comment - In Chapter 7, adopting budgets by ordinance. This could <br />place the budget in a referendum situation. <br /> <br />Commissioner Sieber - Stated whether or not to adopt the budget by ordinance <br />or resolution has not been decided by the Commission yet - it is still up <br />for discussion. If the budget is adopted by resolution, Council has the <br />authority to do so. If the budget is adopted by ordinance, people have the <br />right to input but they are also obtaining a great deal of power and taking <br />on a terrific responsibility. The Commission does not know if it is legal to <br />adopt budgets by ordinance. A compromise suggested was that specific items <br />in the budget be subject to referendum by requiring that they be adopted by <br />ordinance. <br /> <br />Audience Comment - I would not like to see a budget by ordinance -- not even <br />line items. Cities and counties are required by State law to set a levy <br />limitation by October 10 of each year. Suppose a much needed project comes <br />along, like Rum River Bridge Crossing and we had to match funds being offered <br />by State and Federal government. We have to have the ability to move funds <br />around in our budgets. <br /> <br />Chairman Heitman - I have trOuble accepting the fact that everything has to <br />be done right now today. <br /> <br />Audience Comment - It happens.
