Commission consensus is that Section 5.07 <br />could use some rephrasing; there seems to be some <br />double negatives, The intent of these last two sentences <br />should be that the default condition is for the referendum <br />to fail. Commission consensus is to carry this item <br />on the punchlist for Attorney Dorn's review and to <br />adopt this section as is for the time being. <br /> <br />Chairman Heitman restated what he had been informed <br />by League of Cities regarding ordinances and budgets -- <br />that it is a gray area. Commission consensus is not <br />to define ordinance in the charter based on the fact <br />that those persons who should be capable of defining <br />it cannot. This item is stricken from the punchlist. <br /> <br />Commission consensus is that the charter shall create <br />as little as Possible with regard to City positions <br />and offices, and Council will create what is necessary <br />for the City. This item is to be stricken from the <br />punchlist and Mr. Schnelle is to be informed of the <br />Commission's decision. <br /> <br />Commissioner Sieber stated that the City's argument <br />against adopting the Long Term Financial Plan by <br />ordinance is that the City would be obligated to <br />follow that plan. Commissioner Sieber stated that he <br />doesn't feel this would be the case; that the ordinance <br />could be amended. Commissioner Sieber stated that he <br />would like the Long Term Financial plan to be adopted <br />by ordinance so that it would be subject to initiative <br />and referendum. <br /> <br />Commission consensus is to change the first sentence of <br />of Section 7.05.01 to read as follows: 'The City <br />Council shall have prepared a Long Term Financial Plan <br />of at least five years commencing in the calendar year <br />1984.'
