Mr. Goodrich referred to Section 4.02.01 and stated that an
individual cannot hold an elected office in the City and run
for another office at the same time; that person must resign
his/her current office.

Mr. Heitman noted that the resignation does not become effective
until the election is certified.

Mr. Goodrich stated that this could allow for a council vacancy
between the time of election certification and the first day of
the year.

Mr. Goodrich also noted that the Charter allows Council to call
for an advisory election on any question they deem appropriate.

Mr. Goodrich proceeded to review Chapter 5.

Mr. Goodrich referred to Section 5.08 and inquired as to an
elected officer's recourse to oppose recall if he or she feels
they are innocent of charges made.

Mr. Sieber replied that State statute says that if malfeasance,
misfeasance or nonfeasance cannot be proved, the elected official
cannot be recalled from office.

Mr. Goodrich stated that caution should be taken prior to initiating
a petition to recall; the elected officer should be entitled to
a hearing if he feels he is not guilty.

Mr. Goodrich proceeded to review Chapter 6.

Mr. Goodrich referred to Section 6.02.02 and the requirement that
Council hires and removes personnel by resolution; does this
apply to part-time personnel and what if a situation arises
where a substitute is called in to take the place of part-time
personnel.

Mr. Data stated that the City is getting to specific; just see
that the work gets done however the City sees fit.

Mr. Goodrich referred to Section 6.02.01 and stated that Council
can establish departments, offices and agencies and prescribe
their functions by ordinance.

Mr. Heitman pointed out that the word 'may' is used and stated
that Council is not compelled to establish offices; the section
was included as a tool to be used by Council if there is a
department that needs tightening up.

Mr. Goodrich proceeded to review Chapter 7.

Mr. Goodrich stated that the City is required to adopt a long
term financial plan; there are certain before and after publication
requirements associated with budget adoption and the City must
adopt a purchasing policy by ordinance.

C/July 10, 1984
