(Please refer to findings of fact file for <br />Findings of Fact .) <br /> <br />Motion fails for lack of a second. <br /> <br />Councilmember Van Wagner expressed concern as to whether or <br />not allowing this reduced assessment would set a precedent. <br /> <br />Mr. Schnelle reiterated that the platting itself is in error; <br />the original home site, during platting, was not adequately <br />protected from Lot 2. <br /> <br />Motion by Councilmember Sorteberg and seconded by Councilmember <br />Van Wagner to adopt Findings of Fact regarding Robert and <br />Bonnie Johnson's request for abatement of the proposed street <br />assessment for Lot 2, Block 3, Rolling Green Addition, with the <br />following addition: (Please refer to findings of fact file <br />or project file for Findings of Fact ). <br /> <br />"Lot 2, Block 3, Rolling Green Addition, is not legally <br /> buildable unless a subdivision were to take place <br /> which would exclude the garage located thereon." <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers <br />Reimann, Sorteberg, Schlueter and Van Wagner. Voting No: <br />None. <br /> <br />Council consensus was to waive the reading of the proposed <br />resolution. <br /> <br />Motion by Councilmember Sorteberg and seconded by Councilmember <br />Van Wagner to adopt Resolution #84-132 approving of Robert and <br />Bonnie Johnson's request for abatement of assessment on Lot 2, <br />Block 3, Rolling Green Addition. (Please refer to resolution <br />file for Resolution 384~132). <br /> <br />Motion carried. Voting Yes: Mayor Gamec~ Councilmembers <br />Sorteberg~ Reimann, Schlueter and Van Wagner.
