the Council. <br /> <br />City Attorney Goodrich stated that a metes and bounds subdivision is not <br />required to go before the Planning and Zoning Commissionl. <br /> <br />Motion by Councilmember Sorteberg and seconded by Councilmember Van Wagner <br />to approve Mr. Brand's request to subdivide a 2-1/2 acre parcel off of his <br />20 acre parcel by metes and bounds. <br /> <br />Further Discussion: Mr. Brand inquired that if a metes and bounds <br />subdivision is granted, must he obtain a survey of the whole 20 acre <br />parcel. Mr. Berg replied that if the Brands Plat, a survey of the entire <br />20 acres is necessary; if they subdivide by metes and bounds, only the 2- <br />1/2 acre parcel need be surveyed. Mrs. Brand inquired as to why her <br />neighbors did not have as much difficulty subdividing. Mayor Gamec replied <br />that this is the first time that Council has been approached by the <br />Brands;that the Brands have talked to Staff but not to Council. Mayor <br />Gamec also noted that there are new ordinances in effect that some previous <br />subdivisions did not have to encounter. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Sorteberg, <br />Schlueter and Van Wagner. Voting No: None. Absent: Councilmember <br />Reimann. <br /> <br />Case #3: <br /> <br />Adoption Of Negative Findings Of Fact By Resolution Regarding <br />Waste Management Of Minnesota, Inc. 's Request For A Conditional <br />Use Permit: <br /> <br />City Attorney Goodrich read out loud the proposed resolution to adopt <br />negative findings of fact regarding Waste Management's request for a <br />conditional use permit. <br /> <br />Mr. Edward Moersfelder - Representing Waste Management of Minnesota, Inc. - <br />Stated that the amended findings have been reviewed and his purpose in <br />attending tonight's meeting is to submit a 4-page statement on those <br />findings and Waste Management's application for a conditional use permit. <br />In summary, the statement takes issue with the findings and expresses the <br />viewpoint that the records do not support the findings. Mr. Moersfelder <br />requested that Council one more review the findings that were prepared by <br />Waste Management and submitted to Planning and Zoning and adopt those <br />findings and grant the permit. Mr. Moersfelder then read, out loud, the 4- <br />page statement and submitted same for the record. (See Attachment A to <br />these minutes.) <br /> <br />City Attorney Goodrich referred to the 4-page statement and comments made <br />regardin~ Mr. Bjorklund's testimony at the June 25, 1984 public hearing <br />and stated that Mr. Bjorklund's initial comments are what should be <br />considered and not Mr. Berres' interpretation of those comments. Mr. <br />Goodrich also stated that if Council reviews the findings prepared by <br />Waste Management, they should also review all minutes, supporting <br />documentation and testimony throughout this case and be comfortable with <br />their decision. <br /> <br />Motion by Mayor Gamec and seconded by Councilmember Van Wagner to adopt <br /> <br />Page 13 of 24 <br /> <br /> <br />
