Sheila Morgan - Inquired as to how much cover is needed for the existing <br />landfill. <br /> <br />Mr. Otter replied that he is unable to calculate exact quantities. <br /> <br />Sheila Morgan stated that Waste Management should know how much soil is there <br />for the existing landfill; reiterated that she was told the material was <br />needed for Site P. Ms. Morgan also noted that this in not the public hearing <br />and she knows there are concerned residents that would like to speak on the <br />issue but could not attend tonight. <br /> <br />Mr. Fountain referred to November 3, 1984 publication of the Anoka Union in <br />which it states that Waste Management wants to buy the property in order to be <br />in a position to operate the site as a landfill designated by Metro Council <br />and County under the Waste Management Act. Mr. Fountain inquired as to why <br />Waste Management wants to buy the property when it will be owned by the <br />County. <br /> <br />Mr. Otter replied that it is a business option they are exercising. Mr. Otter <br />then stated that his firm has met City requirements and requests that the <br />Council approve the application for mining permit. <br /> <br />Councilmember Schlueter quoted a portion of Section 473.806 of the Waste <br />Management Act - "No county, city or town land use control shall permit <br />development which has not been approved by the council, nor shall any county, <br />city or town sanction or approve any subdivision, permit, license or other <br />authorization which would allow develoI~nent to occur which has not bee <br />approved by the council." <br /> <br />Motion by Councilmember Van Wagner and seconded by Councilmember Schlueter to <br />table action regarding Waste Management's request for a temporary conditional <br />use permit for mining purposes until after January 1, 1985. <br /> <br />Motion carried. Votin9 Yes: Mayor Gamec, Councilmembers Sorteberg, Reimann, <br />Schlueter and Van Wagner. Voting No: None. <br /> <br />Motion by Councilmember Van Wagner to schedule a public hearing on January 22, <br />1985 regarding Waste Management's request for a Temporary Conditional Use <br />Permit for mining. <br /> <br />Further Discussion: City Attorney Goodrich stated that the applicant must be <br />treated fairly; let him know where he is at. Mr. Goodrich also stated that <br />this Council should probably not set a public hearing for the new Council <br />taking office January 1, 1985; this Council can authorize that the setting of <br />a public hearing date regarding Waste Management's request for a Temporary <br />Conditional Use Permit be included in the Council's agenda for their first <br />meeting in January, 1985. <br /> <br />Motion failed for lack of a second. <br /> <br />Motion by Councilmember Van Wagner and seconded by Councilmember Schlueter <br />that the setting of a public hearing date regarding Waste Management's request <br />for a Temporary Conditional Use Permit be included in the Council agenda for <br /> <br />PAGE 14 OF 26 <br /> <br /> <br />
