Mr. Goodrich stated that this action <br />would be an accommodation to the developer and added that it is not his <br />intention to allow compromising of the charter requirment that an ordinance <br />does not become effective for 30 days after publication. <br /> <br />Mr. Dorn stated that the risk involved is that the people could petition for <br />the ordinance to be put to a referendum and the ordinance could be <br />defeated; Mr. Dorn stated that there has been no controversy on this PoU.D. <br />and he does not expect the ordinance to be put to a referendum. Mr. Dorn <br />added that construction cannot begin until the Spring of 1985. <br /> <br />Mr. Goodrich stated he is not recon~ending, but Council can grant final plat <br />approval contingent upon the rezoning ordinance becoming finalized. <br /> <br />Council consensus was to waive the reading of the proposed resolution. <br /> <br />Motion by Councilmember Van Wagner and seconded by Councilmember Reimann to <br />adopt Resolution #84-240 approving the final plat of the Rum River Hills <br />Planned Unit Development contingent on the rezoning of the site to P.U.D. <br />designation. (Please refer to resolution file for Resolution #84-240). <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Sorteberg, Reimann, <br />Schlueter and Van Wagner. Voting No: None. <br /> <br />Motion by Councilmember Van Wagner and seconded by Councilmember Sorteberg to <br />authorize the Mayor to enter into a development agreement with Rum River Hills <br />ssociates for the Rum River Hills Planned Unity Development contingent upon <br />City Staff approval. <br /> <br />Motion carried. Voting No: None. <br /> <br />Mr. C~odrich stated he will bring the final draft of the restrictive covenance <br />back to Council for review. <br /> <br />Motion by Councilmember Van Wagner and seconded by Councilmember Schlueter to <br />acknowledge the introduction of Ordinance #84-19 regarding the rezoning of the <br />Rum River Hills P.U.D. site to P.U.D. and Ordinance #84 -z0 regarding the <br />vacation of White Pines Park and part of Helium Street Nw. <br /> <br />Motion carried.
