Commissioner introduced the following resolution and moved for its adoption: <br /> <br />PROPOSED RESOLUTION #93-06- <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A <br />REQUEST FOR A VARIANCE TO SIDE YARD SETBA~EQUIREMENTS ON <br />PARCELS IN THE PLAT OF AMBER RIDGE <br /> <br /> WHEREAS, Gor-em, I ii.C, hereinafter referred to as "Applicant", has properly applied <br />for a Board of Adjustment variance from Section 9.20.12 of the Ramsey City Code to consumct <br />homes with a side yard setback of six (6) feet versus ten (10) feet on the garage side of the parcels <br />on the property legally described as follows: <br /> <br />AMBER RIDGE, Anoka County, State of Minnesota. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF <br />MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Board of Adjustment for a public hearing pursuant <br />to Section 9.03.05 of the Ramsey City Code on June 7, 1993 and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />as a part of these findings by reference. <br /> <br />2. That the subject parcels within the plat of Amber Ridge are zoned R- 1 Urban Residential. <br /> <br />That Section 9.20.12 of the Ramsey City Code establishes a smacture setback of ten (10) <br />feet from side propexty lines. <br /> <br />That the Applicant has stated that the current market mend is for homes designed with triple <br />attached garages. <br /> <br />That the Applicant has provided the City with information that indicates the footprint width <br />of homes with triple garages ranges from 62'8" to 64'. <br /> <br />6. That the standard lot width in the urban area is eighty (80) feet. <br /> <br />That the home footprint plus twenty (20) feet for two 10-foot side yards exceeds the <br />standard urban lot width in the City. <br /> <br />That City Staff has surveyed surrounding communities and it has been determined that a <br />majority of the communities require a five (5) to six (6) foot side yard setback on the garage <br />side of the property. <br /> <br />That the special conditions causing the undue hardship do not resuk from the actions of the <br />Applicant as the Applicant is not responsible for setting the market trend. <br /> <br /> <br />
