Board Member <br /> <br />innoduccd the following resolution and moved for its adoption: <br /> <br />PROPOSED RESOLUTION g93-06- <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A <br />REQUEST FOR A VARIANCE TO CONSTRUCT AN"XI)DITION TO THE <br />GARAGE THAT WILL ENCROACH ON THE THOROUGHFARE SETBACK ON <br />THE PROPERTY GENERALLY KNOWN 4911 179TH LANE N.W. <br /> <br /> WHEREAS, Michael H. and Karen A. Segar, hereinafter referred to as "Applicants", <br />have properly applied for a Board of Adjustment variance from Section 9.20.11 of the Ramsey <br />City Code to construct an addition to their attached garage that will encroach on the C.S.A.H. #27 <br />thoroughfare setback on the property generally known as 4911 179th Lane N.W. and is legally <br />described as follows: <br /> <br />That pan of the North half of the Northeast Quarter of Section 1, Township 32, Range 25, <br />Anoka County, Minnesota, described as follows: From a point on the East line of said <br />Section 1, being 12.76 chains south of the Northeast comer of said Section I, and also the <br />centerline of public road, then south 82 degrees 30 minutes west on said centerline of <br />public road for a distance of 1,010 feet, then north on east line of road easement and <br />parallel with said east line of Section 1 for a distance of 228 feet, then east at fight angles <br />for a distance of 150 feet to actual point of beginning, then south at fight angles for a <br />distance of 183.5 feet to said centerline of public road, then southwesterly on said <br />centerline of public road for a distance of 151.8 feet, then north 205.75 feet to point of <br />beginning and subject to public road fight-of-way. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF <br />MINNESOTA, as follows: <br /> <br />That the Applicants appeared before the Board of Adjustment for a public hearing pursuant <br />to Section 9.03.05 of the Ramsey City Code on June 24, 1993 and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />as a pan of these f'mdings by reference. <br /> <br />That the subject property is zoned R-1 Rural Residential and is approximately .6 acres in <br />size. <br /> <br />3. That the subject property is surrounded by R-1 Rural Residential zoning. <br /> <br />That Section 9.20.11 of the Ramsey City Code requires a structure setback from <br />thoroughfares of 110 feet from the thoroughfare centerline or 50 feet from the property <br />line, whichever is greater. <br /> <br />That the principal structure on the subject property is located approximately 98 feet from the <br />C.S.A.H. #27 eenterline and approximately 80 feet from the front property line. <br /> <br />That the principal structure on the property was constructed in 1967 prior to the <br />establishment of thoroughfare setback requirements and is therefore considered lawful <br />nonconforming. <br /> <br />That the Applicant is proposing to construct a 14' x 23' garage addition to the principal <br />structure that will also encroach on the thoroughfare setback to approximately the same <br />degree as the existing principal structure on the property. <br /> <br />The proposed construction is considered expanding a lawful nonconforming structure and <br />to do so must be in conformance with City Code, i.e. obtaining a variance. <br /> <br /> <br />
