That construction of the accessory structure in a manner that meets the thoroughfare setback <br />will require removal of mature tree growth and the addition of a substantial amount of fill. <br /> <br />10. <br /> <br />That the subject property is entitled to a total of 2,064 square feet of garage and accessory <br />building space; that the total area of the existing accessory structures and proposed structure <br />is 1,950 square feet. <br /> <br />11. <br /> <br />That there is a substantial amount of mature n'ee growth on the subject property that will <br />screen the proposed accessory structure from C.S.A.H. #57. <br /> <br />12. <br /> <br />That the Applicant has stated that the variance requested is the minimum variance which <br />would alleviate the hardship. <br /> <br />13. <br /> <br />That there are unique circumstances applying to the subject property that do not generally <br />apply to other properties in the district; namely, that additional setback requirements are <br />imposed on properties abutting thoroughfares and there is a sharp decline in topography <br />beyond the 110 foot setback from C.S.A.H. #57. <br /> <br />14. <br /> <br />That the special conditions causing the undue hardship do/do not result from the actions of <br />the Applicant. <br /> <br />15. <br /> <br />That such variance is/is not necessary for the preservation of a substantial property right <br />similar to that possessed by other properties in the R-1 Rural Residential District, namely <br />achieving the amount of allowable accessory structure space established by City Code for a <br />parcel this size. <br /> <br />16. <br /> <br />That if granted, the variance will/will not grant the Applicant any special privilege that is <br />denied to other owners of lands, structures or buildings in the same district <br /> <br />17. <br /> <br />18. <br /> <br />That if granted, the variance wilVwill not be materially detrimental to the purposes of the <br />Ram~ey Zoning Chapter or other property in the R-1 Rum/Residential District. <br /> <br />That if granted, the variance will/will not substantia~lly increase the congestion of public <br />streets, or increase the danger of fire, or endanger the public safety, or substantially impair <br />property values within the neighborhoocL <br /> <br />19. <br /> <br />20. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br /> and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same: <br /> <br />and the following abstained: <br /> <br />and the following were absent: <br /> <br />whereupon said resolution was declared duly adopted by theRamqey Board of Adjustment this the <br />~ day of ,1993. <br /> <br /> Chairperson <br />ATTEST: <br /> <br />City Ad m inistmtor <br /> <br /> <br />
