Board Member <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />A RESOLUTION <br /> <br /> RESOLUTION gO3-09- <br />APPROVING THE ISSUANCE'OF A VARIANCE AND <br /> DECLARING TERMS OF SAME <br /> <br /> WHEREAS, James McChesney has properly applied for a variance to construct an <br />accessory structure that will encroach on the C.S.A.H. #57 (Sunfish Lake Blvd. N.W.) <br />thoroughfare and that will be nearer the front property line than the principal structure on the <br />property generally known as 15429 Sunfish Lake Blvd. N.W. and legally described as follows: <br /> <br />That part of the Southwest Quarter of the Northwest Quarter of Section 23, Range 32, <br />Township 25 described as follows: Commencing at the northeast comer of said Southwest <br />Quarter of Northwest Quarter, then south on the east line a distance of 510 feet, then west <br />and parallel to the north line of the Southwest Quarter of Northwest Quarter a distance of <br />347 feet to the center of town road, then north 20 degrees east on the centerline of said <br />town road a distance of 544 feet to the north line thereof, then east on the north line of said <br />Southwest Quarter of Northwest Quarter a distance of 165.2 feet to the place of <br />commencement (except that part platted as Anoka County Highway right-of-way No. 1 <br />recorded 7/16/74). <br /> <br /> WHEREAS, the Board of Adjustment met on September 7, 1993, conducted the public <br />hearing and adopted findings of fact relating to the request to encroach on the 110 foot <br />thoroughfare setback for C.S.A.H. #57. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF <br />MINNESOTA, as follows: <br /> <br />Based on Findings of Fact g.. ., a variance to construct a 25' x 30' accessory structure <br />that will encroach on the C.S.A.H. #57 thoroughfare setback and wi. il be nearer the front <br />property line than the principal structure is hereby granted. <br /> <br />The accessory structure shall maintain a minimum distance of ninety-two (92) feet from the <br />centerline of C.S.A.H. #57. -- <br /> <br />3. This variance shall not apply to any future structure(s) placed on the property. <br /> <br />4. The prop. erty owner shall obtain all necessary permits prior to commencing any <br /> construction. <br /> <br />The property owner herein agrees that no commercial activity shall be conducted from the <br />accessory stmcun:e. <br /> <br />The property owner shall be responsible for all City costs incurred in administering and <br />enforc/ng th/s variance. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br /> and upon vote being taken thereon, the fo~owing voted in favor thereof: <br /> <br />and the following voted against the same: <br /> <br />and the following abstained: <br /> <br />and the following were absent: <br /> <br />whereupon said resolution was declared duly adopted by the Ramsey Board of Adjustment this the <br />7th day of September, 1993. <br /> <br /> <br />
