CASE <br /> <br />JIM TROWBRIDGE UTILITY CONNECTION CHARGE <br /> By: Steve Jankowski, City Engineer <br /> <br />Background: <br /> <br />We have received a request from Mr. Jim Trowbridge to reconsider the charges which <br />would be incorporated into a development agreement associated with the subdivision of a <br />property he owns on 149th Lane N.W. This property, is directly across from the Ramsey <br />Meadows subdivision and has benefitted from street ~mprovements and sewer and water <br />availability as a result of this subdivision. As such, the property would be subject to the <br />City's policy for assisting individuals with hook-up charges to water and sewer utilities <br />receiving availability from subdivision extensions. This policy is attached and was <br />developed as a result of Mr. Trowbridge appearing before the City Council last fall when <br />the Ramsey Meadows subdivision was undergoing its final stages of approval. <br /> <br />The Committee will be familiar with this policy as it was recently reaff'u'med at the July 27, <br />1993 Council meeting where this issue was discussed in connection with the final plat <br />approval of the Sharon Lee Addition. As you will recall, from that meeting the Council <br />directed Staff to develop a mechanism to assist the subdividers in overcoming the cash flow <br />problem of having to satisfy the lateral benefit charges prior to being allowed to record the <br />plat and consequently sell the additional lot. However, the Council did reafFm'n the <br />provision of the policy which requires that the property not be allowed to be subdivided <br />until the fair share cost (lateral benefit) of the improvements be recouped by the City. <br /> <br />In addition to the Sharon Lee case, the Council has also recouped lateral benefit costs from <br />previously installed trunk infrastructure into other cases. In the case of Anna Boe, who <br />owns property on County Road #5, lateral benefit from an existing water trunk line in the <br />amount of $6,700 was collected when Mrs. Boe requested to hook up her individual <br />residence to the trunk line. Also, with Improvement Project g02-13, two properties which <br />are having sanitary sewer service extended will be charged for the lateral benefit of the <br />existing watermain trunk. Lateral benefit charges in the amount of $8,700 will be collected <br />in this instance. <br /> <br />Recommendation: <br /> <br />It is Staffs recommendation to reaffu'm the existing policy for assisting individuals with <br />hook-up charges to water and sewer utilities receiving availability from subdivision <br />extensions.
