Councilmember <br />adoption: <br /> <br />introduced the following resolution and moved for it's <br /> <br />RESOLUTION #93-02- <br /> <br />A <br /> <br /> RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A <br />REQUEST TO AMEND THE BUSINESS AND RESI"D'~NTIAL ZONING <br /> DISTRICT BOUNDARIES IN THE PLAT OF RIVENWlCK <br /> <br />March <br /> <br />CITY <br />1) <br /> <br />2) <br /> <br />3) <br /> <br />4) <br /> <br />5) <br /> <br />6) <br /> <br />7) <br /> <br />8) <br /> <br />9) <br /> <br />I0) <br /> <br />11) <br /> <br />WHEREAS, the City of Ramsey received an application from Faye Construction, Inc. on <br />1, 1991 to amend the zoning district boundaries in the plat of Faye 2nd Addition); and <br /> <br />NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That Faye Construction, hereinafter referred to as "Applicant", has properly applied for a <br />rezoning to malign the boundaries of the Residential and Business zones within the plat of <br />Faye 2nd Addition. <br /> <br />That the Planning and Zoning Commission conducted a public hearing pursuant to Section <br />9.03.03 of the City Code on March 5, 1991 and that said public hearing was properly <br />advertised and that the minutes of said public hearing are hereby incorporated by reference. <br /> <br />That on April 23, 1991, the City Council adopted Findings of Fact #91-04-085 and <br />introduced an ordinance to amend the zoning district boundaries (B-3 Highway Business, <br />B-1 Business and R-1 Urban Residential) to coincide with the block lines as the plat was <br />proposed to be platted. <br /> <br />That subsequent to the introduction of the rezoning ordinance, the plat name was changed <br />to Rivenwick, the legal descriptions used in the ordinance changed based on changes to the <br />final plat since preliminary plat approval, and the applicant has requested the elimination of <br />the B-1 Business District and replacing it with B-3 Highway Business. <br /> <br />That City Staff determined that the revisions to the proposed rezoning justified repeating the <br />procedure for zoning amendments as established by City Code. <br /> <br />That the Planning and Zoning Commission conducted a second public hearing pursuant to <br />Section 9.03.03 of the City Code on February 2, 1993 and that said public hearing was <br />properly advertised and that the minutes of said public hearing are hereby incorporated by <br />reference. <br /> <br />That the total area of Rivenwick is 103 acres. <br /> <br />That the subject plat is bounded on the north by Hwy. #10, on the south by the Mississippi <br />River, on the east by B-3 Business and R-I Urban Residential zones, and on the west by <br />Anoka County Park property. <br /> <br />That the plat of Rivenwick is currently zoned B-3 Highway Business, B-i Business and R- <br />1 Urban Residential. ,, <br /> <br />That the Applicant is proposing to eliminate the B-1 Business zoning and amend the zoning <br />district boundaries of the B-3 Business District and the R-1 Urban Residential District to <br />coincide with the plat of Rivenwick as it has been recorded. <br /> <br />The City Staff has taken the position that the B-1 Business District should not be eliminated <br />from the plat of Rivenwick as it serves as a buffer between the residential use and the <br />intense commercial activity allowed under the B-3 Business District regulations. <br /> <br /> <br />
