Councitmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #93-02-., <br /> <br />RESOLUTION ADOPTING FINDING OF FACT ~ <br /> REQUEST FROM BARTON SAND AND GRAVEL, <br /> CONDITIONAL USE PERMIT FOR MINING <br /> <br /> RELATING TO A <br />INC. TO RENEW A <br />OPERATIONS <br /> <br /> WHEREAS, the City of Ramsey received an application from Barton Sand and Gravel, <br />Inc., for a conditional use permit renewal to continue mining operations on Pin Nos. 27-32-25-21- <br />0001 and 27-32-25-22-0001. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the <br />findings of fact relating to the request are determined to be as follows: <br /> <br />That on August 25, 1987, a conditional use permit was issued to Barton Sand and Gravel, <br />inc. for extracting aggregates in the Industrial District, and that said permit expired on <br />December 31, 1992. <br /> <br />That on December 17, 1992, Barton Sand and Gravel, Incorporated, herein after referred to <br />as "Applicant", has properly applied for a renewal of their conditional use permit to extract <br />aggregates in the I-1 Industrial District. <br /> <br />That the applicant appeared before the Ramsey Planning and Zoning Commission for a <br />public hearing pursuant to Section 9.03.04 of the City Code on February 2, 1993, and that <br />said public hearing was properly advertised and that the minutes of said public hearing are <br />hereby incorporated as a part of these findings by reference. <br /> <br />That the subject property is legally described as follows: <br /> <br />The north half of the northwest quarter of Section 27, Township 32, Range 25, <br />Anoka County, Minnesota except the following described tract: <br /> <br />That part of the northwest quarter of the northwest quarter of said Section 27 <br />described as follows; commencing at the southwest corner thereof, thence north on <br />the west line of said northwest quarter of the northwest quarter for a distance of 418 <br />feet; thence east and parallel with the south line of said northwest quarter of the <br />northwest quarter a distance of 209 feet; then south and parallel to said west line to <br />the said south line thereof; thence west on said south line to the point of <br />commencement. <br /> <br />That the subject property is located in the Industrial District, and is approximately 78 acres <br />in size. <br /> <br />That the eastern 38 acres of the site is occupied by D.N.R. Wetland #2-118W, a designated <br />protected wetland. <br /> <br />That the site is also located in the Shoreland Overlay District. <br />That mining is not a permitted use in the Industrial District. <br /> <br />That the adjacent land to the north is zoned R-1 Rural Residential, and is developed. <br /> <br /> <br />
