Councitmember introduced the following resolution and moved for its adoption: RESOLUTION #93-02-., RESOLUTION ADOPTING FINDING OF FACT ~ REQUEST FROM BARTON SAND AND GRAVEL, CONDITIONAL USE PERMIT FOR MINING RELATING TO A INC. TO RENEW A OPERATIONS WHEREAS, the City of Ramsey received an application from Barton Sand and Gravel, Inc., for a conditional use permit renewal to continue mining operations on Pin Nos. 27-32-25-21- 0001 and 27-32-25-22-0001. NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating to the request are determined to be as follows: That on August 25, 1987, a conditional use permit was issued to Barton Sand and Gravel, inc. for extracting aggregates in the Industrial District, and that said permit expired on December 31, 1992. That on December 17, 1992, Barton Sand and Gravel, Incorporated, herein after referred to as "Applicant", has properly applied for a renewal of their conditional use permit to extract aggregates in the I-1 Industrial District. That the applicant appeared before the Ramsey Planning and Zoning Commission for a public hearing pursuant to Section 9.03.04 of the City Code on February 2, 1993, and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. That the subject property is legally described as follows: The north half of the northwest quarter of Section 27, Township 32, Range 25, Anoka County, Minnesota except the following described tract: That part of the northwest quarter of the northwest quarter of said Section 27 described as follows; commencing at the southwest corner thereof, thence north on the west line of said northwest quarter of the northwest quarter for a distance of 418 feet; thence east and parallel with the south line of said northwest quarter of the northwest quarter a distance of 209 feet; then south and parallel to said west line to the said south line thereof; thence west on said south line to the point of commencement. That the subject property is located in the Industrial District, and is approximately 78 acres in size. That the eastern 38 acres of the site is occupied by D.N.R. Wetland #2-118W, a designated protected wetland. That the site is also located in the Shoreland Overlay District. That mining is not a permitted use in the Industrial District. That the adjacent land to the north is zoned R-1 Rural Residential, and is developed.
