That the property to the south is zoned Business Warehouse and is currently Undeveloped. That the property to the west is zoned I-Industrial, however, portions of it are occupied by lawful non-conforming residential uses. That the conditional use permit issued in 1987 required the applicant to construct a six (6) foot berm with trees to provide screening of the mining operation from the two existing residential structures to the west. The applicant planted an excess of trees in this area in lieu of the six foot berm. That the conditional use permit issued in 1987 required the planting of a six foot tree screen on the northern boundary of the property prior to any mining operations encroaching within 660 feet of the northern property boundary. The tree screen has not been planted, and the mining operation has not encroached any closer that 660 feet to the northern property boundary. That there are other similar conditional use permits that have been approved by the City. That since the issuance of this permit in 1987, the permit holder has removed approximately ~ cubic yards of material. That the Applicant estimates that cubic yards of material will be removed from the property over the three (3) year life of the renewed conditional use permit. That over the 3 year life of the renewed conditional use permit, the applicant estimates that truck traffic will increase to the area by approximately ~ truck trips per month. That the mining operation will increase the traffic to the subject property and surrounding area. That the proposed use will/will not be unduly dangerous or otherwise detrimental to persons residing or working in the vicinity of the use or to the public welfare. That the proposed use will/will not substantially adversely impair the use, enjoyment, or market value of any surrounding property. That the proposed use will/will not be operated and maintained so as to be harmonious and appropriate in appearance with the existing or intended character of the general vicinity, and that such use will/will not change the essential character of the area. That the proposed use will/will not be hazardous or disturbing to existing or future neighboring uses. That the proposed use will/will not be a substantial improvement to property in the immediate vicinity and to the community as a whole. That the proposed use will/will not be served adequately by public facilities and services such as highways and streets. That the proposed use will/will not create excessive additional requirements at public cost for public facilities and services, and it will/will not be detrimental to the economic welfare of the community.
