Councilmember introduced the following resolution and moved for its adoption: RESOLUTION NO. 93-02- A RESOLUTION DECLARING TERMS OF CONDITIONAL USE PERMIT, BASED ON FINDINGS OF FACT NO., , FOR MINING OPERATIONS ON PIN NO. 27-32-25-21-0001 AND 27-32-25-22-0001 WItEREAS, the Ramsey City Council adopted Resolution No. 93-02- regarding Findings of Fact No. for this use and herein approves the Conditional Use Permit subject to the following conditions. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: On , 1993, a Conditional Use Permit ("CUP") was issued by the City of Ramsey ("City") to Barton Sand and Gravel, Incorporated ("Permit Holder") for mining operations on the property legally described as follows: The north half of the northwest quarter of Section 27, Township 32, Range 25, Anoka County, Minnesota except the following described tract: That part of the northwest quarter of the northwest quarter of said Section 27 described as follows; commencing at the southwest corner thereof, thence north on the west line of said northwest quarter of the northwest quarter for a distance of 418 feet; thence east and parallel with the south line of said northwest quarter of the northwest quarter a distance of 209 feet; then south and parallel to said west line to the said south line thereof; thence west on said south tine to the point of commencement. This permit is issued pursuant to Section 9.03.04 and 9.1-.18 of the Ramsey City Code. The conditions of this permit are as follows: 1. This permit shall expire on May 1, 1996. All equipment used for mining operations shall be maintained and operated in such a manner to minimize noise, dust, and vibrations adversely affecting surrounding properties. All equipment shall be kept in good repair. Abandoned equipment and rubbish shall be removed from the worksite regularly. All hauling operations shall be completed so as to minimize noise, safety and dust concerns adjacent to residential properties. All worksites shall be properly safeguarded to prevent the general public from depositing garbage or other refuse on the worksite. 5. Existing tree and groundcover shall be preserved to the extend feasible. Mining operations shall be conducted in such a manner to minimize interference with the surface water drainage outside the boundaries of the operation. No mining operations shall occur at below an elevation of 6 feet above the elevation of the water table on the worksite.
