o <br /> <br />10. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />15. <br /> <br />t6. <br /> <br />Fencing may be ordered by the City Council or City Engineer anytime the permit is in force <br />and shall be installed within 24 hours of written notice. <br /> <br />All access roads from the mining operation to the public sn'eets shall be maintained in order <br />to minimize dust. <br /> <br />The maximum slope other than the working face shall be sloped on all sides no steeper than <br />a rate of 2 foot horizontal to 1 foot vertical. In no case shall the slope of the working face <br />be left unattended with a slope greater than 2 feet horizontal to 1 foot vertical. When <br />mining operations are anticipated to be discontinued for an interval greater than one <br />working day, the slopes shall be flattened to a grade no steeper than 4 feet horizontal to 1 <br />foot vertical. <br /> <br />No mining operation shall be conducted closer than 30 feet to the right of way line of any <br />existing or platted street, road or right of way. <br /> <br />Prior to commencing any mining operations, a cash escrow or letter of credit approved as <br />to form by the City in the amount of $20,000 shall be deposited with the City. This <br />financial guarantee may be used by the City to pay for the cost and expense of repairing any <br />public right of ways due to the mining operation, pay for any cost associated in <br />administering the requirements of this Chapter of the City Code, and to pay for any <br />restoration of the worksite not properly restored upon completion. <br /> <br />The permit holder shall file with the City a liability insurance policy or certificate of such <br />insurance acceptable to the City and issued by an insurance company authorized to do <br />business in the State of Minnesota. <br /> <br />a. The policy shall insure the permit holder for the sum of at least $300,000 for injury to <br /> one person and $500,000 for one accident, and at least $1,100,000 property damage. <br /> <br />Said policy shall be for the full period of the permit and shall provide for the giving of <br />10 days prior notice to the City by registered mail of termination, cancellation or <br />amendment of the policy. <br /> <br />Co <br /> <br />In the event said policy is terminated for any reason, the permit shall be automatically <br />suspended upon the day the policy terminates unless a new policy complying with this <br />item is obtained and filed with the City prior to the termination of the policy in force. <br /> <br />The maximum noise level at the perimeter of the worksite shall be within the limits set by <br />the Minnesota Pollution Control Agency and the Environmental Protection Agency of the <br />United States. <br /> <br />Ail mining operations shall be conducted in accordance with the updated grading plan and a <br />phasing and restoration plan and said plan shall not allow for more than five acres to be <br />exposed at any one time. However, the applicant may be restoring one five acre site while <br />commencing operations on another five acre site. The phasing and restoration plan shall be <br />provided to and approved by the City Engineer prior to any excavation and extraction. <br />Restoration as used herein shall be defined as meaning grading and topsoil replacement and <br />grass seeding such that turf is established that will prevent water and wind erosion. <br /> <br />A buffer area shall be provided between 75 and 125 feet in width along the northern <br />boundary of the property and shall include trees of the density, variety and size to be <br />approved by the City Engineer.
