19.

The City received emissions test resuhs for tests performed December 20 and 27, 1990 and
July 17, 1992. Emissions test ,,vas not provided in 1991.

The emission of smoke, odor, and dust/ash particulates shall be in compliance with MPCA
standards.

i have requested testing by MPCA.

The status of Lots 2 and 3, as they relate to Item #14 of the conditional use permit, is as follows:

Term: A site plan and conditional use permit application must be submitted for Lots 2 and 3 by
March 11,199I or the permit holder shall:

a)
b)
c)
d)

e)

Screen the bus storage area front public su'eets by June 1, t991
Pave the semi trailer parking area on Lot 2.
Remove all debris from Lots 2 and 3.
Screen all dumpsters fi'om public streets. The number of dumpsters on Lots 2 and
3 shall be limited to two for containment of office waste.
Storage of buses for feedstock on Lots 2 and 3 as of November 1, 1990 ma),
continue until the supply is completely reduced. No additional or replacement stock
may be brought to tile property.

Status:

On March I5, 1991, in accordance with the term described above, Mr. Karst did submit a
site plan application to pave a portion of Lots 2 and 3 for additional customer/employee
parking and outside storage and a 5,800 square foot building expansion on Lot I. He also
submitted an conditional use permit amendment application to permit the disassembly of
engines and transmissions within the building. The Planning and Zoning Commission
recommended approval of the site plan and conditional use pem'fit amendment. Mr. Karst
requested that these cases be temporarily tabled from City Council review. Thirteen
months later, in April of 1992, Mr. Karst indicated his willingness to proceed with his
cases but that there were modifications to his conditional use permit amendment request and
site plan application. In July I received the revised plans which proposed the acceptance of
other non-hazardous metals in addition to disassembly of engines and transmissions and
the construction of a new building on Lots 2 and 3 versus expansion of the existing
building. The}, were submitted to Planning and Zoning and they recommended approval.
Council denied the conditional use permit amendment and no action was taken on the site
plan for the new building since the activity to be carried on within the building was
contingent upon the conditional use permit amendment being approved.

During all this time, the storage activity on Lots 2 and 3 has not been screened. The
storage of bus feedstock has not continuously reduced until it was eliminated altogether. It
appears that there are efforts currently being made to clear debris from these lots.

The status of Lot 4 as it relates to the Industrial District zoning regulations is:

Regs:

City Code states that a conditional use permit is required in order to have exterior storage as
a principal use of a property in the Industrial Distirct. The issuance of the conditional use
permit is contingent upon the lot being surfaced to control dust.

Status: Mr. Karst is using Lot 4 for exterior storage purposes and a conditional use permit has not
been issued. It appears there are efforts currently being made to clear debris from this lot.
