Councikr~mber its adoption: introduced the following resolution and moved for PROPOSED RESOLUTION ~t93-06 A RESOLUTION APPROVING/DENYING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO DANNY'S TRANNY'S, INC., AND DECLARING TERMS OF SAME. WHEREAS, Daniel Karst, Jr. of Danny's Tranny's, Inc., has properly applied for a conditional use permit on the property legally described as follows: Lots 2 and 3, Block 4, Gateway North Industrial Park Plat #2, Anoka County, Minnesota (Subject Property); and WHEREAS, the Planning and Zoning Commission met on June 1, 1993, conducted the public hearing and recommended City Council approval/denial of the request. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: Based on Findings of Fact # , a conditional use'permit to disassemble engines and transmissions and conduct wholesale operations is hereby granted to Daniel Karst, Jr., Danny's Tranny's, Inc., hereinafter referred to as "Permit Holder". This permit shall remain in effect so long as the conditions imposed herein are complied with. Noises emanating from the site and operations shall be in compliance with and regulated by the State of Minnesota Pollution Control Standards, Minnesota Rules 7010.0010 to 7010.0080, as amended or except as modified herein by City performance requirements. The emission of odor from the operation shall be in compliance with and regulated by the State of Minnesota Pollution Control Standards, Minnesota Rules 7005.0920, as amended except as modified herein by City performance requirements. The City may order the Permit Holder to undertake corrective actions within specific time frames based on test results or evaluations to remedy pollution problems or nuisance complaints. If the Permit Holder fails to take corrective action within specified time frames, it may be determined by the City Council to be a violation of the CUP and cause for permit revocation. Disassembly of engines and transmissions shall be conducted wholly within a building and in accordance with County, State and Federal requirements. All liquid waste, waste solvents, cleansers, or wastewater generated from the disassembly and cleaning of vehicle engines or transmissions shall be collected and stored in a leakproof system in accordance with state and federal regulations and then transported off site. Waste fluids shall be stored inside the building in sturdy, leakproof storage containers or tanks in accord with MN Rules 7045.0526 or 7045.0528. The Permit Holder shall submit a copy of the original shipping manifest and the completed manifest for hazardous waste quarterly to the City Zoning Administrator, A copy of the application submittal for a Hazardous Waste Facility permit shall be submitted to the City concurrently with submittal to Anoka
