19. 20. 21. 22. 23. The use of trailers, trucks or vehicles for long term storage (longer than 30 consecutive days) is prohibited. All vehicles and trailers on site must bear a current license, be registered, and must be mad worthy. The placement, design and construction of new structures or additions to existing structures and site improvements shall comply with City Code and applicable state codes and OSHA requirements. The Permit Holder agrees to connect to City sewer and water at the time sewer and water is extended to the area and herein agrees to join in a petition for such improvements when such petitions are presented. In the event this CUP is revoked or the Permit Holder closes operation of the facility for any reason, including but without limitation, by order of the court or other agency of competent jurisdiction, bankruptcy, insolvency, or abandonment, the Permit Holder shall immediately proceed to remove all materials from the site. In the event the Permit Holder fails to comply with the terms of this CUP, the City may, upon 30 days' written notice to the Permit Holder enter into the property and perform all such obligations, the costs of which shall be borne by the Permit Holder or, in default thereof, by its surety. Danny's Tranny's, Inc. shall submit financial assurances as follows: (a) Charges and Fees. Danny's Tranny's, Inc. agrees to pay to the City upon the issuance of this CUP a fee in an amount sufficient to reimburse the City for engineering, legal and administrative expenses reasonably incurred during the consideration and development of this CUP. The Perm/t Holder shall reimburse the City for all fees incurred by the City in connection with inspection of the facility and administration of this CUP. In the event the City incurs additional reasonable costs occasioned solely by the presence of this use within the City of Rarnsey for personnel training, specialized equipment, risk insurance or increased contract costs for providing fzre department services, the Permit Holder agrees to reimburse the City at cost upon presentation of supporting documents and invoices consistent with applicable law. (b) Liability Insurance and Liability Indemnification. The Permit Holder shall secure and maintain insurance from an insurance company acceptable to the City and authorized to write casualty insurance in the State of Minnesota which will protect the Permit Holder, its agents and employees and the City from claims for bodily injury, death or property damage which may arise from the operations on the Subject PropertyA The Permit Holder shall file a certificate of insurance or a cerfi.fied copy of the insurance policy with the City. Such insurance policy shall conta/n a clause providing that it shall not be cancelled by the insurance company without thirty (30) days' written notice to the City of intention to cancel. The following coverages shall be provided in amounts not tess than those specified: i. Public liability, general liability; personal injury and property d,mage: (I) (2) (3) (4) Injury or death of one person - $1,000,000. Injury to more than one person ina single accident - $1,000,000. Property damage - $1,000,000. Total Aggregate Liability for all items $1,000,000.
