Councilmember introduced the following resolution and moved for its adoption: RESOLUTION ~q~93-10- A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO THOMAS AND CARRIE OSLON'S REQUEST FOR A-CrO~DITIONAL USE PERMIT TO MAINTAIN A HORSE ON A PARCEL LESS THAN THREE (3) ACRES IN SIZE WHEREAS, Thomas and Carrie Olson, hereinafter referred to as "Applicants", have properly applied for a Conditional Use Permit to maintain a horse on less than three acres on the property generally known as 15811 Okapi Street N.W. and legally described as follows: Lot 3, Block 2, THE NORTH FORTY 2ND ADDITION, Anoka County, Minnesota. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That the Applicants appeared before the Horse Care Board on September 21, 1993 and that the Board has recommended that the City of Ramsey approve/deny the application to maintain a horse on less than 3 acres. That the Apphcant appeared before the Planning and Zoning Commission for a public hearing pursuant to Section 9.03.04 of the Ramsey City Code on October 5, 1993 and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated by reference. 3. That the subject parcel is approximately 2.4 acres in size. That the subject parcel is zoned R-1 Rural Residential. That the surrounding parcels are also zoned R-1 Rural'Residential. That Section 5.09.05 of the Ramsey City Code states that a maximum of 2 horses may be maintained on a parcel ranging in size from 1.5 acres to less than 3.0 acres with a conditional use permit. That Section 5.09.04 of the Ram.qey City Code states that no stable or barn that houses horses may be located within 50 feet of a place of human habitation. That Section 9.20.11 of the Ramsey City Code states that no buildings housing animals may be within 75 feet of neighboring property lines. 10. 11. That the Applicants have submitted a site plan which indicates that there is a mn-in shed that provides shelter for the horse that is located approximately 150 feet from the home and 52 feet from the neaarest property line. That the site plan submitted also indicates that there ~s approximately one (1) acre of fenced roaming area on the property. That there are other similar permitted conditional uses within the R-1 Rural Residential District
