19, <br /> <br />The City received emissions test results for tests performed December 20 and 27, t990 and <br />July 17, 1992. Emissions tesl was not provided in 1991. <br /> <br />The emission of smoke, odor, and dust/ash particulates shall be in compliance with MPCA <br />standards. <br /> <br />I have requested testing by Mt~CA. <br /> <br />The status of Lots 2 and 3, as the), relate to Item #14 of the conditional use permit, is as follows: <br /> <br />Term: A site plan and conditional use permit application must be submitted for Lots 2 and 3 by <br /> March 11, 1991 or the permit holder shall: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />e) <br /> <br />Screen the bus storage area from public streets by June 1, 1991 <br />Pave the semi wailer par'king area on Lot 2. <br />Remove all debris from Lots 2 and 3. <br />Screen all dumpsters from public streets. The number of dumpsters on Lots 2 and <br />3 shall be limited to two for containment of office waste. <br />Storage of buses for feedstock on Lots 2 and 3 as of November 1, 1990 may <br />continue until the supply is completely reduced. No additional or replacement stock <br />may be brought to the property. <br /> <br />Status: <br /> <br />On March 15, 1991, in accordance with the term described above, Mr. Karst did submit a <br />site plan application to pave a portion of Lots 2 and 3 for additional customer/employee <br />parking and outside storage and a 5,800 square foot building expansion on Lot 1. He also <br />submitted an conditional use permit amendment application to permit the disassembly of <br />engines and transmissions within the building. The Planning and Zoning Commission <br />recommended approval of the site plan and condition'd use permit amendment. Mr. Karst <br />requested that these cases be temporarily tabled from City Council review, Thirteen <br />months later, in April of 1992, Mr. Karst indicated his willingness to proceed with his <br />cases but that there were modifications to his conditional use permit amendment request and <br />site plan application. In July I received the revised plans which proposed the acceptance of <br />other non-hazardous metals in addition to disassembly of engines and transmissions and <br />the construction of a new building on Lots 2 and 3 versus expansion of the existing <br />building. They were submitted to Planning and Zoning and they recommended approval. <br />Council denied the conditional use pen'nit amendment and no action was taken on the site <br />plan for the new building since the activity to be carried on within the building was <br />contingent upon the conditional use permit amendment being approved. <br /> <br />During all this time, the szorage activity on Lots 2 and 3 has not been screened. The <br />storage of bus feedstock has not continuously reduced until it was eliminated altogether. It <br />appears that there are efforts currently being made to clear debris from these tots. <br /> <br />The status of Lot 4 as it relates to the Industrial District zoning regulations is: <br /> <br />Regs: <br /> <br />City Code states that a conditional use permit is required in order to have exterior storage as <br />a principal use of a property in the Industrial Distirct. The issuance of the conditional use <br />permit is contingent upon the lot being surfaced to control dust. <br /> <br />Status: .Mr. Karst is using Lot 4 for exterior storage purposes and a conditional use permit has hot <br /> been issued. It appears there are efforts currently being made to clear debris from this <br /> <br />5/ <br /> <br /> <br />
