CASE # <br /> <br />MUNICIPAL FACILITY SMOKE FREE ENVIRONMENT <br /> By: Ryan Schroeder, City Administrator <br /> <br />Background: <br /> <br />At the last meeting of the City Council, Staff was directed to draft an ordinance making all <br />City facilities, vehicles and property smoke free. Attached for Council review is the <br />February 17, 1993 memorandum that the City Administrator sent to City Staff requesting <br />their input on the issue. Also attached are some of the documents supplied by <br />Councilmember Beyer regarding this policy. In that Staff has had very lime time to provide <br />comment back to me at the time of this case preparation, I felt it best to wait on drafting the <br />ordinance until sometime just prior to the meeting of the 23rd. <br /> <br />Therefore, it is my intention to provide this ordinance draft to the Council at the table the <br />night of the 23rd. However, I can give you some indication of the comments received to <br />date. While it seems that there doesn't appear to be a large concern making City buildings <br />smoke free, there is a larger concern as to the grounds surrounding municipal buildings and <br />also City park property. The largest stated concern relative to park property has been the <br />enforceability as well as our desire to enforce such a smoking ban. If Council passes an <br />ordinance with the knowledge that it has 1) very little ability to consistently enforce the <br />ordinance; and 2) little desire to actively attempt to enforce it, then it seems that it may be <br />best to consider other avenues to enforce the same end. <br /> <br />Given the above, unless several additional comments to the contrary are received prior to <br />the 23rd, it is likely that Staff will present a recommendation in support of the smoking ban <br />subtracting out grounds around City buildings and park property. <br /> <br />Council Action: <br /> <br />Based upon discussion. <br /> <br />II <br /> <br />Reviewed by: <br /> <br />City Administrator <br /> <br />CC: 02/23/93 <br /> <br /> <br />
