Councilmember Beycr inn'rx:tnce~I the follo~hng re.mlnrion and moved ~ its adoprlon: <br /> <br />RESOLLrrlON 9I..04-087 <br /> <br />RESOLUTION DECLARING CONDITIONS OF CONDITIONAL USE PERMIT <br />FOR AN ALUMINUM PROCESSING PLANT <br /> <br /> WHEREAS, the Ramsey City Council adopted Resolution ~91-04--086, regarding Findings <br />of Fact for this use and heroin approves a Conditional Use Permit su~ect to thc following conditions. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On April 23, 1991, a conditional use permit ("C'UP") was issued by the City of Ramsey ("CID,") to <br />Aluminum Recycling Processing, inc. ("Permit Holder") to operate an aluminum processing plant in <br />the B/'W Business Warehouse District on approximately 2.58 acres of land legally described as <br />follows: <br /> Lot 2, Block 1, Gateway North Industrial Park Plat 1. <br /> <br />Subsequent to that~ the Permit Holdm- assigned iB intmx:st to Alloy Recovery Company. <br /> <br />This permit is issued pursuant to Section 9.03.04 of the R,m.~ey City Code. The conditions of this <br />perrrat are as follows: <br /> <br />Term. This permit shall remain in effect so long as the conditions imposed herein are <br />complied with. <br /> <br />~. Noises emanating from the site and operations shall be in compliance with and <br />regulated by the State of Minnesota Pollution Conn'ol Standards, Minnesota Rules 7010.0010 <br />to 7010.0080, as emended except as modified herein by City pm'formance requirements. <br /> <br />~Dust/A~h~arficutates. The emission of dust, ash or other particulates matter shall be in <br />compliance w/th and regulated by the State of Minnesota Pollution Con~'ol <br />Minnesota Rules 7005.0010 - 7005.0080, 7005.2770 subp. 2.A., and 40 ~ Part 50 as <br />amended except as modified h~reln by City performance requirements. <br /> <br />Odor. The emi.~don of odor from the opm,'afion shall be in compliance with and regulated by <br />the State of Minnesota Pollution Control Stan~, Minnesota Rules 7005.0920, as amended <br />except as modified herein by City p~:fformance requ~ments. <br /> <br />,Smoke. The em~sion of smoke from the operation shall be in eompliance with and reg'ulated <br />by the State of Minnesota Pollution Control standard~, Minnesota Regulation 7005.0480 <br />subp. !.B., as mended except as modified hm'~in by City performance requirements. <br /> <br />Fmnaee Errfissforl~.an~ Monitoring..Emissions from the melt furnace shall comply with State <br />and lzetScral regulations as they exist and may be modified fi'om time to time during the period <br />of ~ CUP. An independent testing laboratoD' shall conduct emissions monitoring'at tea.~t <br />once per year and on a more frequent basis if poliutmats are in excess of standard. The <br />Permit Bolder shall make a complete report available to the CiW within thirty (30) d,ays of <br />completion by the testing laboraxory. At ~ minimum, the parameter~ of such emissions <br />monitoring shall include the following State and Federal criteria pollutant emissions as may <br />exist fi'om time to time during the term of tiffs permit. 'The cost of such testing and reports <br />shall be borne by the Permit Holder. <br /> <br /> <br />
