This CUP shall not be effective until the City has approved a Site Plan and Building Plans which incorporate these CUP condition~. Closure Due to CUP Revocation. Other Circumstances. In the event this CUP is revoked or the Permit Holder closes operauon of the aluminum processing operation for any reason, including but without llmimtion, order of the court or other agency of competent jurisdiction, bankruptcy, insolvency, or abandonment, the Permit Holder shall immediately proceed to remove all feedstock and other material from the site. In the event the Permit Holder falls to comply with the terms of this CUP, the City may, upon 30 days written notice to the Permit Holder, enter into the property and perform all such obligation~, the costs of which shall ~ borne by the Permit Holder or, in default thereof, by its surer)'. F~nancia] Assurance. The Permit Holder shall submit financial assurances as follows: Charees and Fees. The Permit Holder agrees to pay to the City upon thc issuance of this CUP, ~ fee in an amount sufficient to reimburse the City for engineering, legal and administrative expenses reasonably incurred during thc consideration and development of this CUP. The Permit Holder shall reimburse thc City for all at~m~nistrative fees incurred by the City in connection with inspection of the aluminum processing operation and ~rtministration of this CUP. Cb) In the event the City incurs additional reasonable costs occasioned solely by the presence of this usc within the CiD' of R~m.~ey for personnel n'~ining, specialized equipment, risk insurance or increased contract costs for providing fn'e d~paru'nent services. The Permit Holder agrees to reimburse the City at cost upon presentation of suppomng documents and invoices consistent with applicable law. Liabilirv Insurance and Li~biI~tv Indemnification. The Permit Holder shall se. cure and maintain insurance from an insurance company aeccpmble to the City and authorized to write casualty insm-ance in the State of Minnesota which will protect thc Permit Holder, its agents and employees and the City from claims for bodgy injury, dcath or property damage which m~y arise from thc operations on the Site. The Permh Holder shall file a CenSficate of Insurance or a certified copy of the insurance policy with the City. Such insurance policy shall contain a clause providing that it shall not be canceled by the insurance company without thirty (30) days' written notice to the City of intention to cancel.
