This CUP shall not be effective until the City has <br />approved a Site Plan and Building Plans which incorporate these CUP condition~. <br /> <br />Closure Due to CUP Revocation. Other Circumstances. In the event this CUP is revoked or <br />the Permit Holder closes operauon of the aluminum processing operation for any reason, <br />including but without llmimtion, order of the court or other agency of competent jurisdiction, <br />bankruptcy, insolvency, or abandonment, the Permit Holder shall immediately proceed to <br />remove all feedstock and other material from the site. In the event the Permit Holder falls to <br />comply with the terms of this CUP, the City may, upon 30 days written notice to the Permit <br />Holder, enter into the property and perform all such obligation~, the costs of which shall ~ <br />borne by the Permit Holder or, in default thereof, by its surer)'. <br /> <br />F~nancia] Assurance. The Permit Holder shall submit financial assurances as follows: <br /> <br />Charees and Fees. The Permit Holder agrees to pay to the City upon thc issuance of <br />this CUP, ~ fee in an amount sufficient to reimburse the City for engineering, legal <br />and administrative expenses reasonably incurred during thc consideration and <br />development of this CUP. The Permit Holder shall reimburse thc City for all <br />at~m~nistrative fees incurred by the City in connection with inspection of the aluminum <br />processing operation and ~rtministration of this CUP. <br /> <br />Cb) <br /> <br />In the event the City incurs additional reasonable costs occasioned solely by the <br />presence of this usc within the CiD' of R~m.~ey for personnel n'~ining, specialized <br />equipment, risk insurance or increased contract costs for providing fn'e d~paru'nent <br />services. The Permit Holder agrees to reimburse the City at cost upon presentation of <br />suppomng documents and invoices consistent with applicable law. <br /> <br />Liabilirv Insurance and Li~biI~tv Indemnification. The Permit Holder shall se. cure and <br />maintain insurance from an insurance company aeccpmble to the City and authorized <br />to write casualty insm-ance in the State of Minnesota which will protect thc Permit <br />Holder, its agents and employees and the City from claims for bodgy injury, dcath or <br />property damage which m~y arise from thc operations on the Site. The Permh Holder <br />shall file a CenSficate of Insurance or a certified copy of the insurance policy with the <br />City. Such insurance policy shall contain a clause providing that it shall not be <br />canceled by the insurance company without thirty (30) days' written notice to the City <br />of intention to cancel. The following coverages shall ~ provided in mounts not less <br />than those specified: <br /> <br />i. Public liabitit3,, general liability, personal injm3, and property damage: <br /> <br />ii. <br /> <br />(1) Injury or death of one person - <br />(2) .
