City Attorney Goodrich replied no. <br /> <br />Councilmember Elvig inquired if the letter from the court to the defendant was sent by certified <br />mail. <br /> <br />City Attorney Goodrich replied no. <br /> <br />Councilmember Pearson inquired as to how staff was made aware that the box was broke into. <br /> <br />Councilmember Cook explained that the defendant had the issue placed on the television news <br />explaining how easy the boxes were to break into and that he had a key made for the box. That is <br />where the damages come in because if he has keys for the boxes, then none of the boxes in the <br />City are secure. <br /> <br />Councilmember Kurak inquired when they are talking about damages are they talking about <br />replacing lock boxes. <br /> <br />City Attorney Goodrich replied that the criminal trial would not give the City much in the way of <br />damages. <br /> <br />Councilmember Cook stated that it could cost the City thousands of dollars to replace the <br />lockboxes because the boxes are not safe if the defendant has a key for the lock boxes. He felt <br />that if the City could settle the issue with the defendant and get a certified letter verifying how <br />many keys were made and get those keys back, then they would not have to replace all the boxes. <br /> <br />Councilmember Strommen inquired as to how they could be assured that the defendant did not <br />have more keys made. <br /> <br />Councilmember Elvig stated that if his lock box on his property was compromised and they <br />received a certified letter as part of a settlement agreement, he was not sure that he would feel <br />comfortable with that. <br /> <br />Mayor Gamec advised Councilmembers that if they are contacted on any criminal issue by the <br />person being charged, they should contact the Police Chief before having a discussion with them. <br /> <br />Councilmember Zimmerman inquired if the City was compromising the safety of local businesses. <br /> <br />Director of Public Works/Fire Chief Kapler explained that after the incident occurred, staff went <br />around to local businesses and apologized for the incident and asked that they take the keys back. <br />The business community overwhelmingly supported the Fire Department. <br /> <br />Councilmember Kurak inquired as to what options the City has regarding the lock boxes. <br /> <br />City Council/March 25, 2003 <br /> Page 3 of 5 <br /> <br /> <br />
