We offer the following <br />comments: <br /> <br />Zoning: The subject property is zoned R-I Urban Residential, R-3 Urban Residential and <br />B-2 Business. Accordingly, the City has received an application to rezone the R-3 Urban <br />Residential and B-2 Business portions of the subject property to R-1 Urban Residential to <br />permit development of the entire property with single family homes. The Planning and <br />Zoning Commission has recommended that Outlot B retain its R-3 Urban Residential <br />zoning in the event future development in this area includes muhi-family rather than single <br />family. <br /> <br />General.' The proposed plat consists of approximately 61 acres to be developed with <br />municipal water and sanitary, sewer and subdivided into 123 single family lots. <br /> <br />Lot Sizes and Dimensions: The minimum lot width in the R-1 Urban Residential District is <br />80 feet, or 90 feet on corner lots, and the minimum lot area is 10,800 square feet. All of <br />the lots meet the minimum dimension and area requirements. It has been the City's policy <br />to require 10,800 square feet of area above the wetland. Some of the lots on the northern <br />end of the plat abut non-protected wetlands. These lots average approximately 8,000 <br />square feet of area above wetland. The Planning and Zoning Commission and City <br />Council approved deviation from the 10,800 square feet above wetland policy at the time of <br />preliminary plat approval because tile wetlands are periodically dry and have upland <br />vegetation on them. <br /> <br />Outlot A. River's Bend. Through tax forfeiture, the City acquired Outlot A of River's <br />Bend and by State statute, it is intended for drainage and utility purposes. The developers <br />of Amber Ridge have requested that the City sell this outlot to them to allow for reasonable <br />lot design and meeting minimum area requirements on Lots 7 and 8 of Block 4. The <br />developers have agreed that this lost drainage and utility easement would be replaced as <br />needed in other areas of the Amber Ridge plat. To sell the outlot will require adoption of an <br />ordinance which would not take affect for 30 days following adoption and the developer is <br />striving for a Ma), 1 recording date. Without the benefit of an ordinance being in affect to <br />sell the outlot, it will be necessary for the City to sign off as an interested party on the plat. <br />At its April 13 meeting, the City Council initiated action to have the State lift the drainage <br />and utility deed restrictions on the outlot. <br /> <br /> <br />
