HIGHWAY #10 - OFFICIAL MAP <br /> CASE OF CITY OF RAMSEY <br />By: Megan Wald, Associate Planner ' <br /> <br />Background: <br /> <br />The City has been diligently working to complete the steps necessary to officially map the <br />Highway 10 corridor that will be utilized for future highway improvements. In conjunction with <br />the procedures to officially map the corridor, the Planning Commission and City Council have <br />discussed what types of land use regulations should be implemented along the corridor until the <br />properties are acquired by the City or MnDot. This case contains several actions/motions that are <br />all related to officially mapping the corridor and providing .for appropriate land use controls. <br /> <br />Memorandum of Understanding: <br /> <br />The City, MnDot, and Anoka COunty have partnered together to combine resources, provide <br />better solutions for the Highway 10 corridor, and to coordinate responsibilities among the <br />parties. The Memorandum of Understanding (MOU) provides a chronological order of the events <br />that have occurred up until this point and outlines what the responsibilities are of each partnering <br />agency. The MOU is not a binding contract, however it is a good coordinating document to have <br />between the three agencies in order to accomplish the end goal of implementing the highway <br />improvements. The MOU will be signed by representatives from MnDot and Anoka County. <br /> <br />Enclosed: Memorandum of Understanding <br /> <br />Action: Direct staff to enter into the Memorandum of Understanding between MnDot and <br />Anoka County. <br /> <br />Introduce Official Map Ordinance: Public Hearing <br /> <br />In order to adopt the official map document that is recorded at Anoka County against each <br />affected property, the City will need to establish an ordinance that outlines the official map <br />process that is set forth in State Statutes. The enclosed ordinance, drafted by the City Attorney <br />defines an official map, the implementation process, and establishes a Board Of Appeals and <br />related process. <br /> <br />The state statute references the Board of Appeals/Adjustment as a body that reviews requests <br />(i.e. building permits, site plans, plats) that were denied by a City Council. An Official Map <br />Board of Appeals needs to be established and it would seem appropriate that the City Council <br />appoint members to this board. The City currently has a body that serves as a Board 'of <br />Adjustment and Appeals, however, this board may not be the most appropriate body to assume <br />the role of reviewing site plan and plat requests that were denied by the City Council for a couple <br />of reasons: 1) currently the Board of Adjustment is established to review variance requests 2) the <br />members who serve as the Board of Adjustment are also the same group that serve as the <br />Planning Commission. Since the Planning Commission is required to review site plan and plat <br />requests they would be reviewing plats and site plans along the Highway 10 corridor. It may be a <br />little counter productive to have the same group who reviews and provides a recommendation <br />about land use requests to also serve as the appeal board. <br /> <br /> <br />
