Councilmember introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #04-04- <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO AN <br />APPLICATION FOR MOTOR VEHICLE SALES, REPAIR, AND/OR RENTAL <br />LICENSE ON THE PROPERTY OWNED BY DOUG AND JULIE HILLS AND LEASED <br />BY SR AUTO. <br /> <br /> WHEREAS, in accordance with Section 7.02 (Motor Vehicle Sales, Repair and Rental), <br />the City has received an application for a motor vehicle sales, repair and/or rental license for SR <br />Auto, a business located at the property generally known as 7443 Highway 10 NW (the "Subject <br />Property). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the application are determined to be as follows: <br /> <br />That Section 7.02 (Motor Vehicle Sales, Repair, and Rental), Subd. 2 (License), states <br />that no person shall engage in business as a dealer in motor vehicle sales, repair or rental <br />in the City without first obtaining a license. <br /> <br />That Section 7.02 (Motor Vehicle Sales, Repair and Rental) Subd. 19 (Revocation), does <br />state that a Motor Vehicle Sales, Repair and/or Rental license may be revoked for failure <br />to keep the licensee's premises in an orderly, aesthetically pleasing manner. <br /> <br />o <br /> <br />That as of August 25, 2003, the Subject Property is zoned B-2 Business District and <br />motor vehicle sales, repair and/or rental is a permitted use in this district. Prior to said <br />date, the Subject Property was zoned 13-3 Highway Business District (motor vehicle sales, <br />repair and/or rental was a permitted use). <br /> <br />4. That the Ramsey Fire Department responded to a fire at the Subject Property on <br /> <br />o <br /> <br />That on December 27, 2002, as a result of the fire referenced above, the Fire Inspector <br />conducted an inspection of the property and noted numerous violations of the Fire Code, <br />Building Code, and City Code. These violations included but were not limited to: <br />Salvage vehicles, miscellaneous car parts scattered throughout the property, hazardous <br />fluids being improperly stored, and structural hazards within the garage. <br /> <br />That on January 2, 2003, the City provided written notification to Mark Baskar of SR <br />Auto, who met with the Fire Inspector on site for an inspection on December 27, 2002, <br />that the violations were too severe to allow work to continue on the Subject Property until <br />a certain level of safety, based on both the Fire Code and Building Code, was attained. <br /> <br /> <br />
