Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #04-04- A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO AN APPLICATION FOR MOTOR VEHICLE SALES, REPAIR, AND/OR RENTAL LICENSE ON THE PROPERTY OWNED BY DOUG AND JULIE HILLS AND LEASED BY SR AUTO. WHEREAS, in accordance with Section 7.02 (Motor Vehicle Sales, Repair and Rental), the City has received an application for a motor vehicle sales, repair and/or rental license for SR Auto, a business located at the property generally known as 7443 Highway 10 NW (the "Subject Property). NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating to the application are determined to be as follows: That Section 7.02 (Motor Vehicle Sales, Repair, and Rental), Subd. 2 (License), states that no person shall engage in business as a dealer in motor vehicle sales, repair or rental in the City without first obtaining a license. That Section 7.02 (Motor Vehicle Sales, Repair and Rental) Subd. 19 (Revocation), does state that a Motor Vehicle Sales, Repair and/or Rental license may be revoked for failure to keep the licensee's premises in an orderly, aesthetically pleasing manner. o That as of August 25, 2003, the Subject Property is zoned B-2 Business District and motor vehicle sales, repair and/or rental is a permitted use in this district. Prior to said date, the Subject Property was zoned 13-3 Highway Business District (motor vehicle sales, repair and/or rental was a permitted use). 4. That the Ramsey Fire Department responded to a fire at the Subject Property on o That on December 27, 2002, as a result of the fire referenced above, the Fire Inspector conducted an inspection of the property and noted numerous violations of the Fire Code, Building Code, and City Code. These violations included but were not limited to: Salvage vehicles, miscellaneous car parts scattered throughout the property, hazardous fluids being improperly stored, and structural hazards within the garage. That on January 2, 2003, the City provided written notification to Mark Baskar of SR Auto, who met with the Fire Inspector on site for an inspection on December 27, 2002, that the violations were too severe to allow work to continue on the Subject Property until a certain level of safety, based on both the Fire Code and Building Code, was attained.
