CEDAR HILLS 2ND ADDITION
<br />DEVELOPMENT AG REEMENT
<br />
<br /> CITY OF RAMSEY
<br />ANOKA COUNTY, MINNESOTA
<br />
<br /> THIS AGREEMENT, made and entered into by and between the CITY OF
<br />RAMSEY, a municipal corporation of the State of Minnesota (the "CITY"), and TRUSEK,
<br />INC., a Minnesota corporation, whose address is 12541 Dupond Avenue, Burnsville, MN
<br />55337 (the "DEVELOPER").
<br />
<br /> WlTNESSETH:
<br /> WHEREAS, the DEVELOPER is the fee owner of the following described property
<br />situated in the CITY OF RAMSEY, County of Anoka, State of Minnesota, and legally described
<br />as follows:
<br /> Lots I, 2, 3, 4, 5, 6, 7, 8, 9, t0, 11, 12, 13, 14, 15, 16, I7 and 18, Block 1; Lots 1, 2, 3,
<br /> 4, 5, 6, 7, 8, 9, 10, I 1, I2, 13, t4 and 15, Block 2; Outlot A; Cedar Hills 2nd Addition;
<br /> Anoka Count5,, Minnesota ("Subject Property"); and
<br /> WHEREAS, on May 25, 1993, pursuant to Resolution No. 93-04-054, the CITY
<br />approved the final plat of the Subject Property which plat is known as CEDAR HILLS 2ND
<br />ADDITION (the "Plat"), which approval is contingent on certain requirements, including
<br />DEVELOPER and CITY entering into this Agreement; and
<br /> WHEREAS, the final plat for the Subject Property conforms to the preliminary plat for
<br />Cedar I-[ills approved by the CITY on July 10, 1990; and
<br /> WHEREAS, a mink usage charge is required by the CITY for usage of its Trunk Sewer
<br />and Water System; and said charge has been assessed on the subject property in conjunction with
<br />the C2jar Hilt~ Development Agreement; and
<br /> WHEREAS, the DEVELOPER intends to cause the construction of the following
<br />improvements in the Plat without financial participation on the part of the CITY, to-wit: Sanitary
<br />sewer, storm drainage facilities, watermal.ns and appurtenances, and s~eets with concrete curb and
<br />gutter, which improvements are termed Stage I Improvements in the City Code ("Stage I
<br />Improvements"); and
<br /> WHEREAS, City Code Section 9.50.50 defines "Stage t" Improvements and "Stage ilI"
<br />Improvements which respective defirfitions are used herein when reference is made to "Stage I"
<br />and "Stage IT" Improvements; and
<br />
<br /> WHEREAS, the DEVELOPER desires to constuct the Stage I and Stage II
<br />improvements, except for those Stage 12I Improvements constructed by the CITY.
