Case #2; Request for Preliminar,v PI;il Approval of Amber Ridge; case of <br /> Creekvie~v Crossing Partnership <br /> <br />Zoning Administrator Frolik stated Creekview Crossing Partnership is requesting preliminary <br />approval of Amber Ridge which consists of approximately 61 acres proposed to be developed with <br />approximately 123 single family t, rban residential lots. <br /> <br />City Engineer Jankowski stated that several of the lots were deficient of the minimum 1(1,8()0 <br />square foot area and that 11 lots do nol have 10,800 square feet above the wetland. <br /> <br />Tony Emmerich, representing Creekvicv,' Crossing Partnership, stated that they would not request <br />a variance to lot size, bul they would need a variance from the City's policy of 10,800 square feet <br />above the wetland. <br /> <br />Mr. Jankowski stated there wou}d be 11 lots that would need :~ variance to the City's policy <br />regarding the wethmd. <br /> <br />Mr. Emmerich mentioned th:it the I I lots averaged 15,000 square feet of area each. He added that <br />some people like to leave their back yards go to nature. <br /> <br />Commissioner Deemer inquired whether any storm sewers ran into these wetlands. <br /> <br />Mr. Jankowski explained that the area north of 149th Avenue N.W. drains into a series of three <br />wetlands, with overflow from those wethmds draining out to a stom'~ sewer down 149th and into <br />the Rum River. He added that the area south of 149th Avenue drains either to a sedimentation <br />serge pond and over to a wetland in R}ver's Bend 3rd Addition with an outlet to the Rum River, or <br />there are a couple of catch basins which flow into a backyard-type of holding pond and then out <br />into the storm sewer on 149th and out to the Rum River. <br /> <br />Mr. Emmerich stated they are willing to work with anything reasonable regarding the engineering <br />matters. <br /> <br />Commissioner Hendriksen stated he was not familiar with the wetland policy and inquired about <br />the importance of that issue. <br /> <br />Mr. Jankowski advised that the wetlands are not protected by the Department of Natural Resources <br />but that they are protected by the Wetland Conservation Act of 1992 which says they cannot be <br />destroyed. He stated they would only be using them for drainage and not destroying them. <br /> <br />Chairperson Bawden polled the Commission regarding the importance of the wetland issue. <br />Commissioners Holland, LaDue and Thorud didn't think the wetlands were that severe. <br />Commissioners Deemer, Hendriksen and Terry would like to see lot areas closer to 10,800 square <br />feet above the wetlands. <br /> <br />Mr. Jankowski stated the only way the developer could get closer to 10,800 would be to <br />dramatically redesign the northwest quarter of the plat. - <br /> <br />Commissioner Hendriksen inquired as to how flexible the Commission has been in recent history, <br />and Ms. Frolik stated the City has adhered fairly tight to the 10,800 policy. <br /> <br />Commissioner Deemer stated he didn't think he has ever seen standing water in this area. <br /> <br />Planning <br /> <br />& Zoning Commission/3/2/93 <br /> Page 3 of 7 <br /> <br /> <br />
