WURST, PEARSON, LARSON, UNDERWOOD & MERtZ <br /> <br />Modifications in the procedures are to allow time for individual <br />cities to plan and carry out how you respond to projects and funding <br />alternatives. It also provides that member cities will award <br />contracts for work, not the Commission. A dispute resolution <br />including arbitration provisions is included. <br /> <br />The land acquisition for any project is to be carried out by the <br />cities as directed by the Commission. The Commission will not <br />condemn nor hold real property interests. Pollution and water <br />quality issues are discussed and the Board is given power to <br />investigate pollution and water quality problems. <br /> <br />Subdivision 12 relates to local water management plans which must <br />be prepared by the cities and reviewed and approved by the <br />Commission. <br /> <br />Article VIII. Finances. This article generally follows the law <br />for Minnesota cities. Subd. 2 includes the 50% split in sharing <br />between net tax capacity and area. The old agreement neglected to <br />include how the sharing was to take place, but it was understood by <br />the parties it was to be 50/50. <br /> <br />Subdivision 3 relates to improvement project finances. <br />Subdivision 4 requires the Commission to submit your annual budget <br />and proposed assessments to your member cities by July 1. <br />Subdivision 5 relates primarily to cost allocation options for <br />capital improvement projects. <br /> <br />Article IX. Miscellaneous Provisions. <br /> <br />Subdivision 1. Commission does not have power to bond. <br />Subdivision 2. Commission does not have power of eminent <br />domain. <br />Subdivision 3. Commission does not have power to levy special <br />assessments against private or public land. <br />Subdivision 4. Agreement not to divert water without a permit and <br />meeting certain conditions. <br />Subdivision 5. Vote of member is suspended if in default on <br />payments. <br />Subdivision 6. Agreement to be bound by terms of the Agreement and <br />to work with the Commission. <br /> <br />Article X. Duration. Set until Januaray 1, 2015, and can be <br />continued. Follows state law and regulations about notice if the <br />parties decide to terminate the Agreement. <br /> <br />Article XI.
