Motion by Commissioner Deemer and seconded by Commissioner Hendriksen to recommend that <br />City Council adopt the amended findings of fact relating to a request for a conditional use permit <br />for a temporary structure from School District #i i. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Hendriksen, Holland <br />and LaDue. Voting No: None. Absent: Commissioners Terry and Thorud. <br /> <br />The Planning and Zoning Commission proceeded to review the terms of the CUP. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Holland to amend #3 to read <br />"This permit shall terminate on June 25, 1995~" <br /> <br />Further Discussion: The Commission inquired if the applicant had any objection to omitting the <br />language regarding an extension, and Mr. Jim Hilts, representing the School District, stated they <br />did not. Commissioner La.Due advised that this did not mean the applicant could not apply for an <br />extension. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland, Hendriksen <br />and LaDue. Voting No: None. Absent: Commissioners Terry and Thorud. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Holland to omit #5 requiring a <br />f'mancial guarantee ensuring timely removal of the temporary structure. <br /> <br />Further Discussion: Commissioner Deemer could see no problem with this applicant. <br />Commissioner Hendriksen stated the City needs to have a financial guarantee. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland and LaDue. <br />Voting No: Commissioner Hendriksen. Absent: Commissioners Terry and Thorud. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner LaDue to recommend that City <br />Council approve the request for a CUP for a temporary structure for School District No. I 1. <br /> <br />Motion carried. Voting Yes: Char'person Bawden, Commissioners Deemer, LaDue, Hendriksen <br />and Holland. Voting No: None. Absent: Commissioners Terry and Thorud. <br /> <br />Case #3: Request for a Conditional Use Permit; Case of Danny's Tranny~s, <br /> Inc, (Dan Karst, Jr.) <br /> <br />Commissioner Holland inquired whether Mr. Karst is presently in compliance with his CUP, and <br />Zoning Administrator Frolik stated that she hasn't toured the premises since he was granted his last <br />CUP ~mendment but that she has done several drive-bys which warranted no concerns. Ms. <br />Frolik added that she has seen his collection system for waste oil and he is in compliance with the <br />County. Ms. Frolik stated the Commission should not confuse this proposal for Lots 2 and 3 with <br />an expansion to the facility on Lot 1. She explained that there is no exterior storage proposed and <br />that the fence mentioned in the Public Hearing is to be removed and replaced with turf and wee <br />landscaping. <br /> <br />Dan Karst, owner of Danny's Tranny's, Inc., reminded the Commission that he has been through <br />and passed several inspections by various agencies. He added that this CUP has nothing to do <br />with his CLIP for Danny's Aluminum Processing. He stated that they do not load or unload in the <br />street but occasionally do it in the driveway. He stated that he has not seen any oil nm-off nor has <br />the State or County inspectors.
