Commissioner Deemer inquired why Lot 4 was not included in this request for a CUP. <br /> <br />Zoning Administrator Fmlik stated that the conditional use will be taking place on Lots 2 and 3 but <br />not Lot 4. <br /> <br />Commissioner Deemer stated he would like to see Lot 4 included so the City could control its use. <br /> <br />It was the consensus of the Commission that Lot 4 should be included in the request for a CUP, <br />and Mr. Karst stated he had no objection. <br /> <br />The Planning and Zoning Commission proceeded to review the findings of fact. <br /> <br />It was the consensus of the Commission that #1 through #5 would remain as presented, <br /> <br />Mr. Karst commented on #6 wherein it states that "said activity will cease on Lot 1," and he <br />advised that he did not want to change the CUP for Danny's Aluminum Processing, Inc. <br /> <br />Motion by Chairperson Bawden and seconded by Commissioner Deemer to amend #6 to omit the <br />wording "said activity will cease on Lot I." <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Hendriksen, Holland <br />and LaDue. Voting No: None. Absent: Commissioners Terry and Thorud. <br /> <br />It was the consensus of the Commission that #7 through #11 would remain as presented. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Holland to amend #12 to omit <br />reference to "relocation to." <br /> <br />Motion carried. Voting Yes: Cha/rperson Bawden, Commissioners LaDue, Holland, Deemer and <br />Hendriksen. Voting No: None. Absent: Commissioners Terry and Thomd. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner La.Due to amend #13 to read <br />"That the proposed use will not substantially adversely impair the use, enjoyment or market value <br />of any surrounding property." <br /> <br />Further Discussion: Commissioner Deemer stated that Mr. Karst doesn't always do as he <br />proposes, and that the motion refers to the proposal presented, not past practice. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, LaDue, Hendriksen <br />and Holland. Voting No: None. Absent: Commissioners Terry and Thom& <br /> <br />Motion by Commissioner Holland and seconded by Commissioner Deemer to amend #14 to read <br />"That the proposed use will not create excessive additional requirements at public cost for public <br />facilities and services." <br /> <br />Further Discussion: Commissioner Deemer stated that the word "excessive" allows this motion. <br /> <br />Motion carried. Voting Yes: Chairperson BaWden, Commissioners Holland, Deemer, <br />Hendriksen, and LaDue. Voting No: None. Absent: Commissioners Terry and Thorud. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Holland to amend #15 to read <br />"That the proposed use will not involve uses, activities, processes, materials and equipment and <br />conditions of operation that will be detrimental to persons, property or the general welfare by <br />reason of excessive production of glare, noise, traffic, smoke, fumes or odor." <br /> <br />Planning & Zoning Commission/June 1, 1993 <br /> Page 5 of <br /> <br />I10 <br /> <br /> <br />
