Dedication of Drainage and Utility Easements. Drainage and utility easement shall <br />be dedicated to the CITY as shown on the Final Plat. <br /> <br />Trunk and Lateral Sewer and Water Fees. The DEVELOPER agrees to pay Eight <br />Thousand Six Hundred Ninety Five Dollars and no/cents ($8,695.00) for each of the two <br />lots as fully payment for the lateral benefit of the sewer and water improvement associated <br />with the sewer and water project which made this subdivision possible. The basis of this <br />charge is as determined in the May 10, 1993 memorandum prepared by the City Engineer <br />and attached hereto as Exhibit A. In addition, the DEVELOPER agrees to pay Two <br />Thousand Eight Hundred Thirty Dollars and no/cents ($2,830.00), the current $1,415.00 <br />trunk sewer and water charge for each of the two lots, as this charge is required of all lots <br />receiving access to the sewer and water system. It is understood that these lots will be <br />subject to the then current Metropolitan Wastewater Control Commission Sewer <br />Availability Charge and the City of Ramsey Watr Availability Charge, and any inspection <br />and installation fee which will be due at the time of utility connection. <br /> <br />Hard Surface Driveway and Sodded Boulevards._ Hard surfaced driveways and <br />sodded boulevards are a requirement for each lot in the Plat. Said improvements shall be <br />installed by the building permit applicant or the homeowner at the time the Certificate of <br />Occupancy is issued or as soon thereafter as possible, weather permitting. In the event <br />these improvements are not timely installed, the DEVELOPER, on behalf of ail <br />subsequent owners of lots within the Plat, agrees that the CITY may install said <br />improvements on any lot(s) and specially assess its cost therefore against the lot(s). The <br />DEVELOPER hereby waives al/fight to a public hearing and other statutory rights or <br />City Charter rights granted a property owner relating to special assessments, including the <br />right to appeal the speciai assessment for installation of the improvements described in this <br />paragraph. In addition, the DEVELOPER grants the right to the CITY to enter on each <br />lot of the Plat in order to install the improvements described in this paragraph, in the event <br />it is necessary for the CITY to install these improvements and specially assess the same. <br /> <br />PERMITS AND OCCUPANCY <br /> <br />Municipal Sewer. No Certificate of occupancy for any dwelling constructed on any of <br />the lots in the Plat Mil be issued until the CITY'S municipal sewer system is available for <br />service to the lots as determined by the City Engineer. <br /> <br />.COrlStruction Site Maintenance. The DEVELOPER shall adhere to all City <br />ordinances relating to, but not limited to, dumping of garbage, site development, <br />construction debris, open burning, etc. <br /> <br />Requirements for Building Permits· No building permit for any lot in the Plat shall <br />be issued until (a) a Certificate of Survey, including that information required by the <br />CITY, has been supplied to the City Building Official; and (b) ail the financial obligations <br />required by the CITY have been satisfied.
