preventers shall be installed in each sewer line. IV. PARK DEDICATION: 16. Cash Contribution. The Subject Property is located in the Sunfish Park District. Park dedication shall be satisfied by the DEVELOPER making a cash con~bution in the amount of Nine Thousand Eight Hundred Ninety Six Dollars and Ninety Cents ($9,896.90), which represents Two Hundred Fifteen Dollars and Fifteen Cents ($215.15) for each of the forty-six (,~6) !,o. ts, in accordance with the Development Agreement for Cedar Hills. ' GENERAL 17. _T_re.e and Sod Planting Plan. Sodded boulevards are a requirement for each lot in the Plat prior to issuance of a Certificate of Occupancy. In accordance with the policy established by the City of Ramsey Park and Recreation Commission on June 10, 1993, the DEVELOPER shall submit a tree preservation plan for CITY approval that identifies existing tree growth within the Plat that will be preserved during consnmction. Said plan shall also include provisions for the planting of one two-inch diameter tree (or equivalent thereof) of an approved species at the road frontage or in the front yard of each of the lots in the Plat prior to the issuance of a Certificate of Occupancy. In the event the weather is not conducive to tree or sod planting at the time of Certificate of Occupancy, the DEVELOPER shall place a cash deposit in the amount of $200.00 for trees and $100.00 for sod in an escrow account with the CITY and upon verification of the planting being accomplished, said cash deposit shall be refunded to the DEVELOPER. Failure of the DEVELOPER to comply with the planting requirement within a reasonable rime frame following a determination by the CITY that weather conditions are conducive to planting shall give the CITY authority to cause the planting, the cost of which shall be charged to the Plat escrow account and the DEVELOPER shall not be eligible for a refund of the cash deposit made for this purpose. 18.Tree Disease Prevention and Disr~osal, The DEVELOPER shall prevent the introduction and spread of tree disease into the residual tree populations of the Plat and adjoining properties and reduce the impacts of construction on the residual property of the I I I I I I I I I I I I I I I I I I I
