I <br />I <br />I <br />I <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />! <br />I <br />I <br />I <br />I <br />I <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT TO ESTABLISH A TOWING <br />SERVICE WITH IMPOUND LOT AND AUTO REPAIR FACILITY IN THE <br />INDUSTRIAL DISTRICT; CASE OF CHAMPLIN TOWING <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Champlin Towing is requesting a conditional use permit to establish a towing service with <br />impound lot and an auto repair facility at 14300 Sunfish Lake Blvd. N.W. The subject property is <br />zoned Industrial and towing services and auto repair facilities are not a permitted use in that district. <br /> <br />The following items are enclosed for your review: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br /> Site location map <br /> Site plan <br />Proposed findings of fact <br />_Proposed conditional use permit <br /> <br />The Planning and Zoning Commission conducted a public hearing on October 5 and there were <br />several residents of Hunter's Hill (neighborhood across the street from the subject site) that spoke <br />in opposition to the request. The major concerns of the residents were the potential for <br />groundwater contamination caused by fluids leaking from damaged vehicles and the traffic <br />generated during the evening hours by this 24 hour operation. <br /> <br />Observations: <br /> <br />The subject site is the former D.J. Furnace Cleaning facility and all structures and pavement <br />currently exist on the site. <br /> <br />The towing service will include an impound lot. City Code states that outside storage is permitted <br />in the Industrial District provided the area is surfaced to control dust. The selected location for the <br />impound lot is paved. In conversations with Anoka County Environmental Services and <br />Minnesota Pollution Control Agency, it has been determined that no special permits are required <br />for the impound lot. However, there were recommendations that the conditional use permit be <br />written to require the applicant to apply a sealant to the pavement and use best management <br />practices to reduce the potential for storm water contamination. The auto repair facility on the site <br />will need a hazardous waste generators license to regulate proper collection and disposal of fluids. <br /> <br />The applicant stated at the public hearing that historically speaking, he never has more than 20 <br />impounded vehicles in his lot at any given time. With regard to evening activity, he typically gets 0- <br />2 tow calls between dusk and dawn. <br /> <br />A portion of the site is also fenced. The applicant is proposing to fence in the balance of the site so <br />that the impound lot will be completely contained and separated from the front offices and <br />customer/employee parking area. <br /> <br />City Code requires that the impound lot be screened from neighboring uses and the residential <br />district on the east side of Sunfish Lake Blvd. N.W. Staff and the Planning and Zoning <br />Commission have recommended that wherever chain link fencing is used, a tree screening also be <br /> <br /> <br />
