CASE <br /> <br />REQUEST FOR SITE PLAN REVIEW OF TOP 10 CENTER; <br /> CASE OF 7129 PARTNERSHIP <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />'/7 <br /> <br />Background: <br /> <br />Ron Touchette of the 7129 Parmership is requesting site plan review to expand what will now be <br />called the Top 10 Center at 7129 Hwy. #10 N.W. The site is located immediately west of the <br />Holiday Stationstore and actually consists of two separate parcels, one measuring 1.8 acres in size <br />and the other measuring .1 acre in size. The development on the site currently consists of a strip <br />service center which houses an off-sale liquor store, an auto repair shop and an auto body shop. <br />There also exists on the site a residential structure being rented as a duplex, a small used car sales <br />lot, the office for which is attached to the residential structure, and a detached residential garage. <br /> <br />The applicant is proPosing to expand the property under a 3-phase program as follows: <br /> <br />Phase I - <br /> <br />a) <br />b) <br /> <br />c) <br /> <br />768 square foot expansion to the auto repair suite <br />Construction of a 1,512 square foot accessory structure to the auto body shop trrtye <br />used as a delivery/estimate center <br />Demolition of detached garage behind residential structure <br /> <br />Phase II - <br /> <br />a) Addition of a 5,280 square foot suite to the strip center <br /> <br />Phase 11I - <br /> <br />a) Addition of another 5,280 square foot suite to the strip center <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br /> <br />Site location map <br />Excerpt from County half section indicating the 2 parcels that make up the site <br />Site plan <br />City Staff Review Letter dated September 30, 1993 <br />ProPosed Site Plan Development Permit <br /> <br />Observations: <br /> <br />Although the site consists of two separate parcels, all 3 principal uses (slrip center, duplex, used <br />car lot) exist on one parcel and this is not in conformance with City Code. Therefore, the duplex <br />and car lot are considered non-conforming and as such.the uses may continue to exist. However, <br />to expand the uses would require a conditional use permit. 'If they are ever destroyed to an extent <br />exceeding 50% of their value, they may not be replaced without a conditional use permit. If the <br />uses ever cease for a period exceeding 6 consecutive months, they may not be re-established <br />without a conditional use permit. The developer's ultimate goal is to replat the site into two <br />conforming parcels, demolish the residential structure and office attached thereto, and construct a <br />new commercial structure on the site. <br /> <br /> <br />
