CASE REQUEST FOR A CONDITIONAL USE PERMIT TO HAVE A HORSE ON LESS THAN THREE (3) ACRES; CASE OF CARRIE OLSON By: Zoning Administrator Sylvia Frolik Background: Unaware of City Code requirements regarding the maintenance of horses, Carrie Olson brought a horse onto her property at 15811 Okapi Street N.W. The situation was brought to the attention of the City's Code Enforcement staff and Ms. Olson was notified that she must have a conditional use permit in order to keep a horse on less than 3 acres. On July 30, 1993, Carrie Olson applied for a conditional use permit to maintain a horse on less than 3 acres. On September 21, 1993, the Horse Care Board reviewed the case and recommended approval of the request. On October 5, 1993, a public heating regarding the request was scheduled before the Planning and Zoning Commission. Observations: Carrie's property is approximately 2.4 acres in size and is located in the R-1 Rural Residential zone. Section 5.09.04 of the Ramsey City Code states that no stable or barn that houses horses may be located within 50 feet of a place of human habitation or within 75 feet of property lines. Carrie's horse is stabled in a 8'x9' (72 square foot) mn-in shed located 150 feet from the house and 52 feet from the nearest property line. The mn-in shed is considered non-conforming because it is the structure providing shelter to the animal and it is not 75 feet from property lines. It should be noted that because of the unique shape of the Olson property, they are limited to constructing a horse shelter a maximum of 15 feet wide, in the middle of the yard, approximately 50 feet from the house in order to comply with the 75 foot setback from all property lines. Based on this, the Planning and Zoning Commission has recommended that a variance be granted within the conditional use permit to allow for the horse shelter to remain at least 50 feet from property lines as long as the conditional use permit is in effect. There is a 12' x 16' shed adjacent to the mn-in shed and fenced pasture that is used to store horse feed and equipment and other miscellaneous personal equipment. This structure does meet the side yard setback requirement, however, the exterior facing finish on the shed is tarpaper which is not in compliance with City Code for parcels less than 2.5 acres in size. The Olson's do have to complete the structure with an exterior finish that complies with City Code. The fenced in pasture area is approximately 1.1 acres in size. If the roaming area exceeds 1/2 acre per horse, City Code exempts the property from the requirements for a manure storage area and weekly disposal of manure. At the meeting of the Horse Care Board, the Applicant mentioned that several neighbors have requested using the manure to fertilize their yards and gardens; the balance of the manure is dispersed on the Olson property for the same uses. The Horse Care Board has recommended that winter accumulations of manure be dispersed by May 1 of each year. 4q
