CITY OF RAMSEY <br /> ANOKA COUNTY, MINNESOTA <br />DEVELOPMENT AGREEMENT - NORTHFORK POINT 2ND ADDITION <br /> <br />I <br />I <br />I <br />I <br /> <br /> THIS AGREEMENT, made and entered into by and between the CITY OF <br />RAMSEY, a municipal corporation of the State of Minnesota (the "CITY"), and NORTH <br />FORK, INC., 713 Bradford Avenue N.W., Champlin, Minnesota 55316 ("the <br />DEVELOPER"). <br /> <br />WITNESSETH: <br /> <br /> WHEREAS, the DEVELOPER and Paul E. Havel and Pamela J. Havel, husband and <br />wife, are the fee owners of the following described property situated in the CITY OF <br />RAMSEY, County of Anoka, State of Minnesota, and legally described as follows: <br /> <br />I <br />I <br />I <br /> <br />Lots 10, 11, 12 and 13, Block 1, Northfork Point 2nd Addition, Anoka County, <br />Minnesota <br /> <br />the "Subject Property"; and <br /> <br /> WHEREAS, on October 12, 1993, pursuant to Resolution 93-10-__, the CITY <br />approved the final plat of the Subject Property which plat is known as NORTHFORK POINT <br />2ND ADDITION (the "Plat") contingent on certain requirements, including DEVELOPER and <br />CITY entering into this contract; and <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br /> WHEREAS, no expenditure of CITY funds, will be made until the City Code escrow <br />requirements have been fulfilled by DEVELOPER; and <br /> <br />NOW THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />P.U .D. <br /> <br />City Code Compliance. That the DEVELOPER will develop the Plat in <br />accordance with the City Code, Section 9.20.31, entitled "Planned Unit <br />Development." <br /> <br />Conformance with Plan. The P.U.D. shall be developed pursuant to the <br />"FINAL PLAT FOR THE PLANNED UNIT DEVELOPMENT OF <br />NORTHFORK POINT 2ND ADDITION" consisting of one (1) sheet, <br />prepared by Bradley J. Cannaday Surveying entitled Northfork Point 2nd Addition <br />and dated as received by the CITY on September 8, 1993. <br /> <br />STAGE '1. IMPROVEMENTS <br /> <br />Com_oliance with City Code. That the recitals above and the provisions of the <br />City Charter, Subdivision Code, Zoning Code and Public Improvement Code of the <br />CITY as amended to date hereof, are incorporated herein by reference. <br /> <br />Stage I Improvements Required.
