Goodrich, City Attorney <br /> <br />Background: <br /> <br />As you may recall, the City acquired Outlot A, River's Bend, as tax forfeited property. <br />The City then exchanged this Outlot for trail property from the Amber Ridge Developers. <br />The City continues to hold title to Ouflot A, but now it is known as Lots 1 through 3, Block <br />5, Amber Ridge. We need to give a deed to the developer for these lots. I have prepared <br />an ordinance allowing the City to convey the Amber Ridge lots. Such Ordinance is <br />enclosed. <br /> <br />On a related matter, because we acquired Outlot A through tax forfeiture, title is not good <br />and marketable unless we obtain a deed from the previous owner, or we complete a quiet <br />title action in District court. Obviously, a deed from the previous owner is by far the <br />cheapest way to proceed. I have contacted Rick Foster, a partner of the partnership which <br />previously owned Outlot A who indicates some willingness to sign a deed. Hopefully I <br />can accomplish this with Mr. Foster.
