That the existing soil berm and tree screen on the Site shall remain or be replaced with like <br />material and foliage. <br /> <br />Leachate from finished compost piles and woody waste piles shall be handled in <br />accordance with MPCA regulations and permits issued to the facility. <br /> <br />Any monitoring records shall be made available to the City within 48 hours of request. <br /> <br />Upon <br />CUP, <br /> <br />o <br /> <br />approval of the above items recommended for addition to findings and <br />these issues from the list of concerns remain to be resolved:: <br /> <br />Should the CUP require relocating the biofilter indoors if it fails to function outdoors as <br />presented in the applicant process. <br /> <br />Should the facility be required to provide a back-up generator to assure proper system <br />operations in the event of a power failure. <br /> <br />Should the CUP specify the extent of the penalty for bringing uncovered loads onto the <br />Site. <br /> <br />Proposed amendments to indemnification agreement: <br /> <br />The City attorney has advised that the indemnification agreement be written to the <br />corporanons and exclude individuals. Additionally, is it necessary to require Waste <br />Management's signature to guarantee IPS' obligations. It is recommended that the City <br />Attorney and Finance Officer be directed to ref'me the indemnification agreement~ <br /> <br /> <br />
