Voting Yes: Chairman Zimmerman, Commissioners Hendriksen, <br />LaDue, Shumway, Holm and Terry. Voting No: None. Absent: Commissioner <br />Howel 1. <br /> <br />The Commission recessed at 9:05 p.m. <br /> <br />Cl]airman Zimmerman c~alled the n~eting back to order at 9:25 p.m. <br /> <br />Motion by Commissioner Shumway and seconded by Commissioner Holm to add an <br />additional finding to the proposed findings of fact as follows: <br /> <br />That on the basis of the foregoing Findings, The Commission concludes <br />that the proposed use does comply with the requirements of City Code <br />Section 170.016D and accordingly recommends approval of the <br />application for a conditional use permit by Atlas. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Hendriksen, <br />LaDue, Shumway, Holm and Terry. Voting No: None. Absent: Commissioner <br />Howell. <br /> <br />Motion by Commissioner Holm and seconded by Commissioner Terry to recommend <br />that City Council adopt findings of fact, as amended, relating to At]~as <br />Incinerator, Inc. 's request for a conditional use permit. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Hendriksen, <br />LaDue, Shumway, Holm and Terry. Voting No: None. Absent: Commissioner <br />}lowell. <br /> <br />The Commission proceeded to review the proposed conditional use permit. <br /> <br />Motion by Commissioner Holm and seconded by Commissioner Shumway to add the <br />following condition to the proposed conditional use permit: <br /> <br />15. <br /> <br />At such a time as the City of Ramsey develops it's own noise, <br />odor or ~nission standards for incinerator uses, the City shall <br />have the option to enforce those standards or delegate to MPCA <br />or U.S. EPA standards. <br /> <br />Further Discussion: Commissioner Hendriksen inquired as to the prospect of <br />enforcing this proposed condition. Mr. Goodrich replied that Atlas has <br />testified at public hearings that they would comply if the standards are <br />reasonable. Commissioner Holm stated that the intent of this proposed <br />condition is to provide the City with the ability to maintain a certain <br />level of standard in the event MPCA relaxes it's standards.
