Case #4: Zoning (A. Mrs. Cindy Rychner Regarding Cattle; B. Zoning Problems <br /> In General): <br /> <br />a) Mrs. Cindy Rychner re§ardin§ Cattle and Zoninq Ordinance - <br /> <br />Mr. and Mrs. Rychner were present at the meeting and presented pictures to Council <br />of cows on Mr. Nugent's property. The animals are pastured on the east side of <br />Ford Creek and they wade across the creek up into the Nugent's old feed lot area. <br /> <br />Attorney Goodrich stated that there would be a problem trying to prosecute the <br />Nugents because it is a criminal offense and the City would have to prove <br />intent. <br /> <br />Mr. Rychner stated that the Nugent's put up an 8'high corrugated steel fence <br />that he is forced to look at all the time, therefore the Nugents should be <br />required to comply with city ordinance and keep the cows off their property. <br /> <br />Councilmember Reimann stated that this has become a neighborhood feud and the <br />City is put right in the middle, furthermore, how much has the City spent <br />already forcing the Nugents to get rid of dogs and pigs? <br /> <br />Jean Schlueter, who was present at the meeting, mentioned that she has talked <br />with Mrs. Hall (owner of cattle) and she claims that the cattle will be out <br />of the area next week and they will no longer rent pasture land from the Dills. <br /> <br />City Attorney Goodrich requested that Mrs. Rychner contact City Staff if the <br />cattle are not gone by November 1, 1982. <br /> <br />b) Zoning Problems in General <br /> <br />Mr. Schnelle stated that the City is still getting complaints regarding the <br />appearance of Mr. Walentiny's property, which he was supposed to have cleaned <br />up by October 1, 1982. <br /> <br />Mr. Walentiny was present and stated that he is having some financial difficulties <br />but will have his property cleaned up by this week-end, but he would like to <br />have permission to keep parts from one truck on his property, as he is in the <br />process of repairing that truck. <br /> <br />Mayor Gamec informed Mr. Walentiny that his ponding area must also be fenced <br />in. <br /> <br />Mr. Walentiny stated that the pond was not made by him, that it has always <br />been there, and that he just dug some of the peat out to spread on his yard. <br />He also stated that right now he can't afford to fence in the pond, that he <br />can't guarantee that he can please his neighbor, but that he will try. <br /> <br />Motion by Councilmember Van Wagner and seconded by Councilmember Reimann <br />directing that Mr. Walentiny have all miscellaneous items on his property <br />picked up by Monday, November 1, 1982; that the truck cab will be back on <br />truck chassis by Monday, November 8, 1982; that the pond area will be fenced <br />in and piles of dirt will be leveled by Monday, November 15, 1982. <br /> <br />Motion Carried. Voting Yes: Mayor Gamec, Councilmembers Sorteberg, Reimann, <br />Cox and Van Wagner. Voting No: None. <br /> <br />C/October 26, 1982 <br />Page 9 of 18 <br /> <br /> <br />
