on this matter, the City should obtain letters from County Attorney and Mr. <br />Hendriksen's attorney stating some facts for the City to go by. <br /> <br />Councilmember Reimann inquired as to the status of the removal of Mr. Duane <br />Lee's driveway onto County Rd. #56. <br /> <br />Mr. Schnelle stated that the driveway has not been removed and he is reluctant <br />to force the issue since Council allowed a second driveway onto a major <br />thoroughfare for Scandinavian Construction, without a Findings of Fact. <br /> <br />Councilmember Cox stated that there is no relationship between between Mr. <br />Lee's driveway and a second driveway for Scandinavian Construction -- that <br />Mr. Lee was in direct violation of Ordinance. <br /> <br />Mayor Gamec stated that the City should be consistent and enforce this <br />Ordinance with regards to other persons on County Rd. #56 with a second access. <br /> <br />Mr. Hendriksen, in getting back to his problem, stated that there is no <br />problem with the County and City Engineers, that the problem is with the <br />County Attorney. Mr. Hendriksen further stated that the County Engineer is <br />going to make it sound like he is right on top of the matter, but in fact <br />he just wants to delay any solution in order for the matter to go to court <br />and he can practice his legal skills. ~. Hendriksen also stated that he <br />has been advised by his attorney to quit stalling and take the matter to <br />court and if it goes to court, the City of Ramsey will be an involved party. <br />He further stated that he has no fight with the City of Ramsey and doesn't <br />want to fight the City of Ramsey in court. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember Reimann to direct <br />City Staff to contact the County Engineer in order to obtain some facts <br />regarding drainage problem on Mr. Terry Hendriksen':s property and further <br />that City Staff report back to Council. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Sorteberg, Cox, <br />Reimann and Van Wagner. Voting No: None. <br /> <br />Mr. Hendriksen repeated that it was in the City's best interest to get this <br />matter resolved, that if it goes to court, the City will be involved and that <br />he does not want to be put in the position of suing the City of Ramsey. <br /> <br />Motion by Councilmember Reimann and seconded by Councilmember Cox to direct <br />City Staff to draw up a Findings of Facts regarding property owners on <br />County Road #56 with a second access onto County Road ~56. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Reimann, Sorteberg, <br />Cox and Van Wagner. Voting No: None. <br /> <br />Case ~3: Federal Cartridge Land Donation to the City of Ramsey: <br /> <br />Motion by Councilmember Sorteberg and seconded by Councilmember Van Wagner <br />to adopt Resolution ~82-158 regarding Federal Cartridge Land Donation to the <br />City of Ramsey, with the following changes: <br /> <br />Item #3 shall be worded as follows: "That the City intends to finance <br />the park improvement over the ten (10) year period by expending $72,000.00 <br /> <br />Sp C/November 3, 1982 <br /> Page 3 of 5 <br /> <br /> <br />
