COUNCIL NEW BUSINESS <br /> <br />Case #8: Gerald Peltzer Mobile Home: <br /> <br />Mr. Goodrich stated that Mr. Peltzer would like the City to <br />back-off on court action and allow Mr. Peltzer to keep the <br />mobile home at his property for purposes of selling. <br /> <br />Councilmember Reimann stated that Mr. Peltzer was granted a <br />temporary permit to have a mobile home on his property, that <br />Mr. Peltzer did not pay the $300 bond and even obtained an <br />extension of time without still paying the bond. Now Mr. Peltzer <br />is requesting Council to change ordinance to help him out and <br />he has not made any effort to cooperate with the City. <br /> <br />Mr. Schnelle affirmed the fact that the City has contacted <br />Mr. Peltzer requesting payment of the bond and Mr. Peltzer <br />has repeatedly failed to do so. <br /> <br />Mr. Goodrich stated that granting a variance to Mr. Peltzer <br />would require a Board of Adjustment public hearing. <br /> <br />Mr. Peltzer stated that if Council would grant him a variance, <br />he would be more cooperative this time. Mr. Peltzer also <br />stated that if he complies with ordinance, he does expect a <br />full refund of the $300. <br /> <br />Mr. Schnelle replied that Mr, Peltzer has not been cooperating <br />with ordinance. <br /> <br />Mr. Peltzer replied that he did not build a home on the property <br />as planned because he could not get financing, and that he now <br />plans to sell the mobile home and farmland and move to Missouri. <br /> <br />Council directs the City Attorney to follow through with legal <br />action against Mr. Gerald Peltzer. <br /> <br />Councilmember Cox stated that nobody desires this action, that <br />Mr. Peltzer has not complied with ordinance and Council must <br />represent all the people and if Council didn't there would be <br />mobile homes parked all over the City. <br /> <br />Mr. Peltzer then requested a special use permit to allow him <br />to live in the mobile home for the winter in order that he <br />can attend to his livestock on the property, <br /> <br />Council consensus is to deny because they have no assurance <br />that the bond would be paid this time either.
