Councilmember Strommen noted this ordinance states food will be served until one hour before <br />close on the days the establishments are open until 2:00 a.m., however, the Council discussion <br />had determined this would be the case every day. <br /> <br />Councihnember Elvig concun'ed. He inquired if the $300 per year fee is for every bar or just <br />those that want to participate in the 2:00 a.m. closing time. <br /> <br />Police Chief Way replied the fee would just be for those that participate in the 2:00 a.m. closing <br />time. <br /> <br />Councilmember Elvig noted there are several typographical errors to be corrected. He asked if <br />there will be a sunset associated with this ordinance. <br /> <br />City Attorney replied there is not a sunset included in the ordinance, however, the motion can <br />state that the ordinance should be reviewed. <br /> <br />Jim Ducharme, representative of J.R.'s Outpost, stated there is an issue with page 187, which <br />outlines subdivision 7 of the ordinance. He explained currently their establishment has all the <br />beer off the tables in that 30 minutes, however, it will be a safety issue to push everyone out. <br />They would like the 30 minutes to have all the drinks gone and an additional 30 minutes to have <br />everyone out. <br /> <br />City Attorney Goodrich indicated this requirement has been in the ordinance for approximately <br />15 years. <br /> <br />Councilmembcr Strommen stated she understands Mr. Ducharme's point, however, it had been <br />explained allowing that full time period would put even more hardship on the police force. <br /> <br />Councihnelnber Elvig stated he was trying to allow for one hour for customers to stay at the bar, <br />and most of the bar owners were not in agreement with that. <br /> <br />Police Chief Way explained the Police Department has a shift that ends at 3:00 a.m. If the time <br />period allowed in the bars is extended to one hour the officers with the 3:00 a.m. ending time to <br />their shift would have to stay on longer. They have discussed having this shift start later, but <br />they are trying to adjust for when they are busy. His understanding was that with the 2:00 a.m. <br />closing there would be 30 minutes allowed to have the customers out of the bar. <br /> <br />The consensus of the Council was to leave the ordinance as presented, and to review it at the <br />public hearing. <br /> <br />Motion by Councilmember Zimmerman, seconded by Councilmember Strommen, to introduce <br />an ordinance regulating the possession, sale and consumption of intoxicating and 3.2 percent <br />malt liquor. <br /> <br />City Council/March 23, 2004 <br /> Page 15 of 26 <br /> <br /> <br />
